Second Reading Item #23 April 24, 1997 VOL 54B4PAGE ,.67 9984 . ------ AN ORDINANCE ABANDONING AND CLOSING A PORTION OF 66TH STREET LOCATED IN SECTION 29, BLOCK AK, LUBBOCK COUNTY, TEXAS, AND A PORTION OF GENOA AVENUE LOCATED IN SECTION 29, BLOCK AK, LUBBOCK COUNTY, TEXAS, EACH OF WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that portions of the street and avenue hereinafter described in the body of this Ordinance are no longer needed for street and avenue purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for street and avenue purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT those portions of the street and avenue as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street and avenue and purposes and for public use, such street and avenue being more particularly described as follows: TRACT ONE A portion of 66th Street located in Section 29, Block AK, Lubbock County, Texas, being further described as follows: BEGINNING at a point in the South right-of-way line of 66th Street which bears N. 89°59' W. 466.68 feet and S. 00°01'43" W. 40.00 feet from the Northeast comer of Section 29, Block AK, Lubbock County, Texas; THENCE N. 00°01'43" E. a distance of 8.00 feet to a set 1/2" rod with cap found at a point of intersection; THENCE S. 89°59' E. a distance of 161.68 feet to a 1/2" rod with cap set for a point of intersection; THENCE S. 86°55'50" E. a distance of 150.21 feet to a 1/2" rod found in the South right- of-way line of 66th Street for a point of intersection; THENCE N. 89°59' W., along said right-of-way line, a distance of311.68 feet to the Point of Beginning. ' . • VOL 54B4rAcE .68 TRACT TWO A portion of Genoa Avenue located in Section 29, Block AK, Lubbock County, Texas, being further described as follows: BEGINNING at a point in the South right-of-way line of 66th Street and the North line of Tract C, Sagewood, an addition to the City of Lubbock, Lubbock County, Texas, which bears N. 89°59' W. 655.02 feet and S. 00°01'43" W. 32.00 feet from the Northeast comer of Section 29, Block AK, Lubbock County, Texas; THENCE Southwesterly along said South right-of-way line around a curve to the left, said curve having a radius of 15.00 feet, a central angle of89°59'17", tangent lengths of 15.00 feet and a chord distance of21.21 feet to a point of tangency in the East right-of- way line of Genoa Avenue and the West line of said Tract C; THENCE S. 00°01'43" W., along said East right-of-way line and the West line of said Tract C, a distance of387.00 feet to a point of curvature; THENCE Southeasterly along said East right-of-way line around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°00'43", tangent lengths of 15.00 feet and a chord distance of21.22 feet to a point in the North right-of-way line of67th Street and the South line of said Tract C; THENCE N. 89°59' W., along said North right-of-way line, a distance of90.00 feet to an "X" found in concrete in the South line of Tract B, Sagewood; THENCE Northeasterly along said North right-of-way line around a curve to the left, said curve having a radius of 15.00 feet, a central angle of89°59'17", tangent lengths of 15.00 feet and a chord distance of21.21 feet to a "X" found in concrete for a point of tangency in the West right-of-way line of Genoa Avenue and the East line of said Tract B; THENCE N. 00°01'43" E., along said West right-of-way line and the East line of said Tract B, a distance of387.00 feet to an "X" found in concrete for a point of curvature; THENCE Northwesterly along said West right-of-way line around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°00'43", tangent lengths of 15.00 feet and a chord distance of21.22 feet to an "X" found in concrete in the South right-of- way line of 66th Street and the North line of said Tract B; THENCE S. 89°59' E., along said South right-of-way line, a distance of90.00 feet to the Point of Beginning. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
