AN ORDINANCE AMENDING ZONING ORDINANCE NO. 169 5 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1278: CHANGE 3 TRACTS OF LAND OUT OF SECTIO
8, BLOCK E-2 .. LUBBOCK COUNTY. TEXAS# FROM AN "R-1" TO "R-2" AND
"R.-3" ZONING DISTRICTS AS INDICATED; SUBJECT TO CONDITIONS.
WHEREAS, the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommendation
which was received by the City Council and after due consideration, the City Counci
finds that making the proposed change as hereinafter set out will be in the public
interest; and,
WHER.EAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices
provided by Article lOllf, Vernon1s Annotated Civil Statutes, amended in 1953, and
notice was duly published in the Lubbock Morning Avalanche Journal more than
fifteen (15) days prior to the date of the public hearing before the City Council on su ~h
proposed amendment, and the public hearing according to said notice was duly held
in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at
which time persons appeared in support of the proposal; and, after said hearing, it
was by the City Council determined that it would be in the public interest.. due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced in final written form prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1278
Change 3 tracts of land out of Section 8~ Block E-2, Lubbock
County, Texas, from an 11R-111 to "R-211 and "R-311 Zoning
Districts as indicated. Property is further described by
metes and bounds to -wit:
TRACT 1 (Change to "R.-311)
BEGINNING at a point in the North line of said Section 8 and at
the East line of Orlando Avenue, City of Lubbock, Lubbock
County, Texas;
THENCE South along the East line of said Orlando Avenue to
a point in the North line of 51st Street if extended east from
Orlando Avenue;
THENCE East along the North line of 51st Street., if extended
East., to a point in the West line of Memphis Avenue;
THENCE North along the West line of Memphis Avenue to a
point in the North line of said Section 8;
THENCE West along the North line of Section 8 to the PLACE OF
BEGINNING.
TRACT 2 {Change to "R-3")
BEGINNING at a point in the North line of Section 8, Block E -2,
and 30 feet East of the East line of Memphis Avenue, City of Lubbock,
Lubbock County, Texas, (Presently only 30 feet wide);
THENCE South to a point in the North line of the alley between 51st
and 52nd Street if extended East from Memphis Avenue;
THENCE East along the North line of said alley if extended as
described to a point in the West line of Kenosha Avenue;
THENCE North along the West line of Kenosha Avenue to the
North line of Section 8;
THENCE West along the North line of Section 8 to the PLACE OF
BEGINNING.
TRACT 3 (Change to "R-211)
BEGINNING at a point in the East line of Orlando Avenue, City of
Lubbock, Lubbock County, Texas, and at the South line of 51st
Street, if extended East, from Orlando Avenue;
THENCE East along the South line of 51st Street., if extended
East from Orlando Avenue., to a point in the West line of Memphis
Avenue;
THENCE South along the West line of Memphis Avenue to the North
line of an alley between 51st Street.~ if extended as described above,
and 52nd Street;
THENCE West along the North line of said alley to a point in the
East line of Orlando Avenue;
THENCE North along the East line of Orlando Avenue to the
PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. THAT the property to be change to "R-3" West of Memphis
Avenue be limited to apartment development only.
2. THAT the property on the east side of Memphis Avenue
be limit ed to apartments and I or medical-clinic development
only.
3. THAT 2 paved off-street parking spaces and 1500 square
feet of lot area be provided for each apartment unit on
the property to be changed to "R-311•
4. THAT 1 paved off-street parking space be provided for each
200 square feet of total floor space of each clinic building.
SECTION 2. THAT from and after passage and effective date of this Ordin ce
said lotsl' tracts and parcels of land described in Section 1 hereof shall be changed
to the zoning district indicated and the Official Map is amended in accordance here-
with.
AND IT IS SO ORDERED.
