HomeMy WebLinkAboutOrdinance - 10131-1998 - Amending Chapter 28 Waiving Pro Rata Charges For Certain Cases Threat Health - 12/16/1998First Reading Item Ho. 39 December 16, 1998 Second Reading Item Ho. 18 January 14, 1999 ORDINANCE NO. 10131 AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO WAIVING PRO RATA CHARGES FOR CERTAIN CASES OF IMMINENT THREAT TO THE HEALTH, SAFETY AND WELFARE OF THE PUBLIC; PROVIDING A SAVINGS CLAUSE; AND PROVIDING PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it in the best interest of the health, safety, and welfare of the citizens of Lubbock to make the following amendments to Chapter 28 of the Code of Ordinances with regard to pro rata charges; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-168 is hereby added to the Code of Ordinance of the City of Lubbock, Texas, to read as follows: Sec. 28-168. Waiver of sewer pro rata charges in cases of imminent threat to health, safety and welfare of public. Pro Rata charges for connection to the sanitary sewer system may be waived only when the following criteria are met: (1) the Public Health Officer declares the situation poses an imminent threat to the health, safety and welfare to the public; (2) the waiver of the pro rata charge is only available to residences occupied by the homeowner; (3) homeowners must have an income at or below the Program Eligibility Level contained in the Emergency Repair Program Income Guidelines as established by the United States Housing and Urban Development Department. SECTION 2. THAT should any paragraph, section, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law.
