Block J-S - 12/16/1998II First lleadiDg It:em No. 35 December 16. 1998 Second Reading It:em No. 16 January 14. 1999 ORDrnANCEN0.-=10=1=29~----- AN ORDrnANCE AMENDrnG ZONrnG ORDrnANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1893-V; A ZONrnG CHANGE FROM A-1 TO A-2 ZONING, FOR APARTMENTS, ON A PORTION OF LAND OUT OF SECTION 2, BLOCK J-S, LUBBOCK, TEXAS; PROVIDrnG A PENALTY; PROVIDrnG A SA YrnGS CLAUSE AND PROVIDrnG FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock A valanche-Joumal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance · and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDArnED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1893-V SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from A-1 to A-2 zoning district, for apartments, on a portion of land out of Section 2, Block J-S, City of Lubbock, Lubbock County, Texas, located at north of 4th Street between Frankford and Milwaukee and being further described as foUows: METES AND BOUNDS: BEGrnNrnG at a concrete nail in shiner found at the Southwest comer of this tract which bears North 89°58'21" East a distance of 1470.57 feet from the Southwest comer of Section 2, Block J-S, Lubbock County, Texas; THENCE North, 50.00 feet pass a 1/2" iron rod with cap set in the North line of 50 foot right-of-way easement, continuing for a total distance of 122.06 feet to a found 112" square iron tube; THENCE North 45° East a distance of 815.00 feet to a 1/2" square tube found at a point of curvature; THENCE Northeasterly, around a curve to the left, said curve having a radius of 152.10 feet, a central angle of 45°, tangent lengths of 63.00 feet, and a chord distance of 116.41 feet to a 1/2" square iron tube found at a point of tangency; THENCE North a distance of37.06 feet to a 1/2" square iron tube found at a point of curvature; THENCE Easterly, around a curve to the right, said curve having a radius of 70.00 feet, a central angle of 155°, tangent lengths of 315.75 feet, and a chord distance of 136.68 feet to a 112n iron rod with cap set over a 112" square iron tube found at a point of tangency; THENCE South 25° East, a distance of 309.15 feet to a 112" square iron tube found a point of curvature; THENCE Southeasterly, around a curve to the left, said curve having a radius of 90.42 feet, a central angle of 83°, tangent lengths of 80.00 feet, and a chord distance of 119.83 feet to a 112" square iron tube found a point of tangency; THENCE North 72° East a distance of 163.16 feet to a 112" square iron tube found at the Northeast comer of this tract; THENCE South, at 544.45 feet pass a 3/8" iron rod found in the North line of a 50 foot right-of-way easement, continuing for a total distance of 594.45 feet to a 60- penny nail found in the South line of Section 2, Block J-S at the Southeast comer of this tract; THENCE South 89°58'21" West, along the South line of Section 2, Block J-S, a distance of 1150.00 feet to the POINT OF BEGINNING: SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. · SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
