Vol 3287 Page 18 Real - 12/10/1998First Reading Item No. 16 December 10, 1998 43870 Second Reading Item No. 12 December 16. 1998 ·voL 6100rAGE124 ORDINANCE NO. 10124 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A TWENTY FOOT UNDERGROUND UTILITY EASEMENT AND GARBAGE SERVICE COLLECTION EASEMENT DEDICATED BY PLAT AND BY UNDERGROUND UTILITY EASEMENT RECORDED IN VOLffivW.3287 PAGE 18 OF THE REAL PROPERTY RECORDS OF LUBBOCK COUNTY, TEXAS LOCATED IN THE CROWN POINTE ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICA TON. WHEREAS, the City Council fmds that the easement portion as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and easement purposes and for public use and it would be in the public interest to close, vacate and abandon the same for easement purposes and public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement portion as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described as follows: FIELD NOTES for closure of a 20 foot Underground Utility Easement and Garbage Service Collection Easement out of Lots 3 through 5 and Tracts "E" through "G", Crown Pointe, an Addition to the City of Lubbock, Lubbock County, Texas and being more particularly described as follows: BEGINNING at a point in the South line of 84th Street, for the most Northerly Northeast comer of this description, whence the Northwest comer of Lot 2, Crown Pointe bears North 74°29'49" East, 114.48 feet; THENCE South 08°36'13" East, 169.75 feet to a point, for a comer of this easement; THENCE North 81 °23'47" East, 6.00 feet to a point, for a comer of this easement; THENCE South 08°36'13" East, 6.00 feet to a point, for a comer ofthis easement; THENCE South 81°23'47" West, 6.00 feet to a point, for a comer of this easement; .. .. -vot6100rAcE125 THENCE South 53°50'31" East, 14.20 feet to a point, for a comer of this easement; THENCE North 80°55'11" East, 83.57 feet to a point, for a comer of this easement; THENCE South 08°36'13" East, 20.00 feet to a point, for a comer of this easement; THENCE South 80°55'11 II West, 86.52 feet to a point, for a comer of this easement; THENCE South 40°28'10" West, 12.98 feet to a point, for a comer of this easement; THENCE South 00001 '10" West, 157.80 feet to a point in the North line of 85th Street, for a comer of this easement; THENCE Westerly, along the North line of 85th Street and a curve to the right, an arc length of 17.96 feet to a 5/8" rod found at the end of said curve, said curve having a radius of850.69 feet and an interior angle of01°12'34"; THENCE North 89°58'50" West, continuing along the North line of 85th Street, 75.00 feet to a Yz" rod found at the beginning of a curve; THENCE Westerly, continuing along the North line of 85th Street and along a curve to the left, an arc length of61.32 feet to a point, said curve having a radius of 1431.78 feet and an interior angle of 02°27'14"; THENCE North 02°26'03" West, 20.00 feet to a point, for a comer of this easement; THENCE Easterly, along a curve to the right, an arc length of 62.17 feet to a point, said curve having a radius of 1451.78 feet and an interior angle of 02°27'14"; THENCE South 89°58'50" East,72.95 feet to a point, for a comer of this easement; 2 VOL 6100PACE126 THENCE North 00001 '10" East, 154.29 feet to a point, for a comer of this easement; THENCE North 08°36'13" West, 50.39 feet to a point, for a comer of this easement; THENCE North 89°58'50" West, 6.00 feet to a point, for a comer of this easement; THENCE North 08°36'13" West, 6.00 feet to a point, for a comer of this easement; THENCE South 89°58'50" East, 6.00 feet to a point, for a comer of this easement; THENCE North 08°36'13" West, 137.25 feet to a point in the South line of 84th Street, for a comer of this easement; THENCE Easterly, along the South line of 84th Street and a curve to the left, an arc length of20.06 feet to the point of beginning, said curve having a radius of 1498.69 feet and an interior angle of00°46'01". SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its fmal passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. 3 VOl 6100PAGE127 SECTION 4. THAT the City Secretary of the City ofLubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
