WHEREAS, the City of Lubbock has recently constructed and enlarged the airline terminal building and adjacent entrance roads, exit roads., service roads, ramps1 taxiways., runways, parking areas, loading areas and other areas for special uses at Lubbock Municipal Airport~ an airport owned and operated by the City of Lubbock, Texas; and, WHEREAS, a great number of vehicles are in operation daily at Lubbock Municipal Airport which creates traffic congestion and hazards to the peace, safety and welfare of the public; and, WHEREAS, there are at present no traffic ordinances controlling the move- ment and parking of vehicles at Lubbock Municipal Airport; and, WHEREAS, the enactment of traffic ordinances to provide for the orderly movement and parking of vehicles at Lubbock Municipal Airport is necessary to preserve the peace, health, safety and welfare of the public; NOW,. THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 18 of the Code of Ordinances of the City of Lubbock# Texas~ as amended~ known as the Motor Vehicle and Traffic Chapter of said Code be and the same is hereby amended by adding a new Article which shall hereafter read as follows: "ARTICLE XII-HEGULATION OF TRAFFIC AT LUBBOCK MUNICIPAL AIRPORT "Section 18-159. Definition of Words and Phrases. -(a) The following words and phrases when used in this Article shall, for the purpose of this Article, have the meanings respectively ascribed to them herein in this Section. ====--~=~~====-=-==-------==------====~-----------===============-================-=---~-= 11(1) Airport Board. -The Airport Board appointed b y the City Council of th City of Lubbock as provided in Chapter 3, Article 2 of the Code of Ordinances of the City of Lubbock. "(2) Authorized Vehicle. -Any motor or other vehicle approved by the Director of Aviation and which displays on its windshield, or other conspicuous place, tf said vehicle has no windshield, a permit issued by the Director of Aviatio designating said vehicle as an authorized vehicle. 11(3) Director of Aviation. -The Director of Aviation of the City of Lubbock, Texas. 11(4) Loading Zone. -A space adjacent to a curb, sidewalk or building re- served for the exclusive use of vehicles loading or unloading materials. 11(5) Lubbock Municipal Airport. -That Airport owned and operated by the City of Lubbock, including terminals, buildings, hangars, shops, roads, entrance roads, exit roads, perimeter roads, service roads, driveways, ramps, taxiways, runways, parking areas .. loading areas .. special use areas and adjacent grounds, located and being all of Section 28, Block A; All of Section 2, Block D-3; the South- east Quarter (SE 1/4), the East half (E 1/2) of the Southwest Quarter (SW 1/4), the South half (S 1/2) of the South half (S 1/2) of the Northeast Quarter (NE 1 I 4), the South half (S 1 12) of the Southeast Quarter (SE 1 I 4) of the Northwest Quarter (NW 1/ ) all in Section 32, Block A; the North half (N 1/2) of the Northwest Quarter (NW 1/4) of Section 10, Block A, all of which is located within Lubbock County, Texas, to- gether with any additional lands or easements now or hereafter added to the pro- perties comprising the Lubbock Municipal Airport. "(6) Park. -Park shall mean to stop a motor or other vehicle and to leave said vehicle unattended by an operator validly licensed to operate said vehicle. "(7) Passenger Loading Zone. -A space adjacent to a curb, sidewalk or building for the exclusive use of motor or other vehicles loading and unloading passengers arriving and departing from Lubbock Municipal Airport. "Section 18-160. Speed Restrictions. -(a) No person shall operate a moto or any other vehicle upon any road, street, entrance road, exit road, perimeter road, service road, driveway, ramp, taxiway, runway, parking area, loading area or other area restricted by the Airport Board to special uses, within Lubbock Municipal Airport at a speed greater than is reasonable and prudent under the conditions then existing having regard to special, actual and/or potential hazards in every event speed shall be so controlled as may be necessary to avoid colliding with any person, motor or other vehicle, or other object in compliance with legal requirements and the duty of all persons to use due care. 11(b) When no hazard exists requiring a lower speed for compliance with Section 18-160 (a) above, no person shall operate or drive a motor or any other vehicle at a greater speed than thirty (30) miles per hour upon the main entrance .. road leading from United States Highway 87 to the Lubbock Municipal Airport Terminal Building nor upon the main exit road leading from the Lubbock Municipal Airport Terminal Building to United States Highway 87 .. on those portions of said entrance and exit road between the intersection of United States Highway 87 with sai entrance and exit roads and the intersection of the road leading to the General Aviation Hangars with said entrance and exit roads., and any speed in excess of thirty ( 30) miles per hour shall be prima facie evidence that such speed is not reasonable or prudent and is unlawful. The Airport Board shall post signs in conspicuous places warning operators of vehicles of said maximum speed limit. "(c) When no hazard exists requiring a lower speed for compliance with Section 18-160 (a) above, no person shall operate or drive a motor or any other vehicle at a greater speed than twenty (20) miles per hour upon the main entrance road leading from United States Highway 87 to the Lubbock Municipal Airport Terminal building nor the main exit road leading from the Lubbock Municipal Airpo t Terminal building to United States Highway 87., on those portions between the intersection of the road leading to the General Aviation Hangars with said entrance and exit roads and the Lubbock Municipal Airport Terminal building and any speed i excess of twenty (20) miles per hour shall be prima facie evidence that such speed is not reasonable nor prudent and is unlawful. The Airport Board shall post signs in conspicuous places warning operators of vehicles of said maximum speed limit. "Section 18-161. One Way Roads. -(a) The main entrance road leading fro In United .States Highway 87 to the Lubbock Municipal Airport Terminal building is hereby designated a one-way road., and no person shall operate or drive a motor or any other vehicle upon said road in any direction except East, as indicated by signs to be placed in conspicuous places by the Airport Board. "(b) The main exit road leading from the Lubbock Municipal Airport Termin~ building to United States Highway 87 is hereby designated a one-way road, and no person shall operate or drive a motor or any other vehicle upon said road in any direction except West .. as indicated by signs to be placed in conspicuous places by the Airport Board. "(c) The Airport Board may designate any other road, lane, service road, perimeter road .. driveway., ramp or taxiway at Lubbock Municipal Airport as one- way for movement of vehicles by posting signs indicating directions for vehicle movement, and no person shall operate or drive a motor or any other vehicle upon said roads, lanes, driveways, ramps or taxiways in any direction except the direction indicated by said signs. "Section 18-162. Do Not Enter. -The Airport Board may erect signs letter ~d "Do Not Enter11 in pr-ominent letters at the entrance to any road, street, lane. driv~ - way, ramp .. taxiway, runway., or area at Lubbock Municipal Airport and no person shall operate or drive any motor or other vehicle past said "Do Not Enter11 sign., except this section shall not apply to authorized vehicles. 11 Section 18-163. Stop Signs. -The Airport Board shall, upon the basis of raffic investigation~ erect stop signs within Lubbock Municipal Airport at inter- sections of roads~ lanes, driveways, ramps, taxiways and runways and at any lace along said roads, lanes, driveways, ramps1 taxiways or runways, where said raffic investigation indicates a traffic hazard exists; and no person shall operate or drive a motor or any other vehicle past such stop signs without first having brought said vehicle to a complete stop and ascertaining that forward movement can be mad ith safety. "Section 18-164. Turn Signs. -The Airport Board may erect 11No, Turn, No Right Turn and/or No Left Turn" signs within Lubbock Municipal Airport at inter- sections of roads, lanes, ramps, driveways, taxiways or runways, and no person shall operate or drive a motor or any other vehicle in such a manner as to execute a turn prohibited by said signs. 11Section 18-165. No Parking Zones. -The Airport Board may establish no arking, no stopping and no standing zones within Lubbock Municipal Airport adjace t to curbs, sidewalks, buildings or near entrances to buildings by posting signs warni g operators of vehicles of the limits of said no parking, stopping or standing zones an no person shall park, stop or stand a motor or any other vehicle in said zone. 11Section 18 -166. Passenger Loading Zones. -The Airport Board may establish passenger loading zones alongside curbs, sidewalks or buildings at Lubbock Municipal Airport by designating said zones with bright paint and lettering and/or by posting signs, and no person shall park a motor or any other vehicle in a passenger loading zone nor shall any person stop or stand a motor or any other vehicle in a passenger loading zone except to load or unload passengers, and then only for a period not to exceed three ( 3) minutes. 11Section 18-167. Loading Zones. -The Airport Board may establish loading zones for the loading and unloading of material at Lubbock Municipal Airport and no person shall stop, stand or park a motor or any other vehicle in a loading zone othe than for the expeditious unloading and delivery pickup and loading of material. In no case shall the stop for loading and unloading of materials exceed fifteen (15) minutes, except on written permission from the Director of Aviation, which shall b for the period of time necessary to complete the one undertaking. 11 Section 18 -168. Special Use Zones. -The Airport Board may designate are s or zones at Lubbock Municipal Airport in which only vehicles of a special kind or t e shall be authorized to park, stop, st~nd or operate by posting signs to that effect, and no person shall operate or drive any motor or any other vehicle or park, stop or stand such vehicle in an area or zone, unless such vehicle is the special kind or type authorized to enter or park, stop or stand in said area or zone. 11 Section 18-169. Public Parking Areas. -The Airport Board may designate areas at Lubbock Municipal Airport for the parking of motor and other vehicles by the public and may post signs regulating the entrance. departure and method and manner of parking of such vehicles, and no person shall operate, park. stop or st any motor or other vehicle except in accordance with such signs . "Section 18-170. Blocking R.oads, Driveways, Ramps, Taxiways and ~ntrances. -No person shall park, stop or stand a motor or any other vehicle in :my road, driveway, ramp, taxiway, parking area, loading area or in front of the ~ntrance of any building at Lubbock Municipal Airport so as to block, obstruct, mpede the free passage of motor or other vehicles or pedestrians. "Section 18-171. Restricted Area. -No person, except operators of authoriz d ~ehicles, shall operate or drive, park, stop or stand a motor or any other vehicle :many service road, ramp, perimeter road, taxiway or runway at Lubbock Municip~ A.irport. 11Section 18-172. Owner Responsible for Illegally Parked or Stopped Vehicles N"o person shall allow, permit or suffer any motor or other vehicle registered in his ~arne to park, stop or stand in violation of any section of this article. If a motor or pther vehicle is found unattended or unoccupied in violation of any section of this ~rticle1 the same is hereby declared to be a nuisance per se and the fact that such f.rehicle is unattended or unoccupied by any person shall be prima facie evidence ~at the owner unlawfully parked such vehicle. 11Section 18-173. Removal of illegally Parked Vehicles. -Motor or other t.rehicles illegally parked or stopped in violation of any section of this article shall bE removed and/or impounded in the same manner as provided for removal of illegally stopped vehicles on the public streets, as set for in Section 18-132. 3 of this Code provided that the Director of Aviation, in addition to the Chief of Police of the City :lf Lubbock, may direct such removal and impoundment of illegally parked vehicles. "Section 18-174. Arrest of Offenders. -Officers of the Police Department of the City of Lubbock and Airport Security Officers or guards duly designated under SE cti• ~ -3 of Chapter 3 of the Code of the City of Lubbock shall issue traffic tickets or notices to answer charges to violators of any of the provisions of this article in the !manner prescribed in Section 18-119 of the Code of the City of Lubbock and in ~ccordance with other applicable sections of Chapter 18 of the Code of the City of !Lubbock. 11Secfun 18-175. (a) The Airport Board is authorized to install parking meters ~nd to designate their hours of operation and the maximum parking time permitted, such metered parking spaces shall be marked by the Director of Aviation as provide in Section 18-106 located as in Section 18-107: Parking meters for use in certain wenty-four minute parking meter zones shall be so situated as to display a signal !showing legal parking within adjacent parking spaces, which parking spaces shall be ~dentified and designated by proper markings. Each parking meter shall, by ~echanical device, begin and continue in operation from the time of deposit of one- ~en cent United States of America coin for a period of twenty-four minutes; parking after expiration shall constitute a parking violation. 11(b) when aay vehicle shall be parked in a parking space alongside of, adjace 1t o and adjoining a twenty-four minute parking meter, the owner, operator, managet or driver of such vehicle shall~ upon entering such parking space, immediately deposit a ten cent coin of the United States of America in the parking meter alongside of~ adjacent to or adjoining such parking space~ and such parking space may then be lawfully used by such vehicle for the purpose of parking during the parking limit of twenty-four minutes. "(c) Overtime Parking. -The parking of any vehicle overtime or beyond thE period of time fixed for any zone wherein a meter is located shall be considered a violation of this Chapter in the same manner as that set out in Section 18-114~ 18-115 and 18-116 of the Code of Ordinances of the City of Lubbock. 11(d) Use of slugs and tampering with meters is prohibited as provided in Section 18-117 and 18-118 of the Code of Ordinances of the City of Lubbock . 11(e) Collection of money deposited in meters; Disposition of Fund. -Unles otherwise provided by the City Council~ it shall be the duty of the Director of Aviation to designate some airport employee to make daily collections of money deposited in the parking meters. Such person so designated shall take from such parking meters the sealed cylinder containing the coins as deposited in the meters and deliver such cylinders with the seals unbroken to the Director of Aviation. It shall be the duty of the Director of Aviation to break or cause to be broken the seals and count the money and deposit same to the credit of the City in the Airport Revem ~ Fund. 11(f) Purpose of levy of coins deposited. -The coins required to be deposite in the parking meters as provided in this division are hereby levied as a police regulation~ supervision and inspection fee to cover the cost of inspection, super- vision and regulation involved in the installation~ operation, upkeep and maintenanc and the use of the parking space and parking meters described in this division1 and involved in checking up and regulating the parking of vehicles in the parking meter zones created as provided in this chapter. "Section 18-176. Records of Violations; Notice on Illegally Parked Vehicles. (a) It shall be the duty of each city officer or airport officer to make a written record of parking violations as set out in Section 18-119. 11(b) Procedure on Arrest. -The procedure on arrest shall be as provided in Section 18-15 of the Code of Ordinances of the City of Lubbock. "Section 18-177. Enforcement and Obedience to Traffic Regulations. -The traffic regulations herein adopted shall be enforced in general conformity with Article 2 of Chapter 18 of the Code of Ordinances of the City of Lubbock except as herein expressly modified. All such violations shall be returnable in the Corporation Court of the City of Lubbock as authorized by Article 46d, Vernon's Annotated Civil Statutes R.evised. 11 SECTION 2. Penalty. -Any person who violates any of the provisions of this Article shall be guilty of a misdeameanor and shall, upon conviction, be punished by a fine of not more than Two Hundred ($200. 00) Dollars. SECTION 3. If any part or parts of this ordinance shall be held to be in- valid, such invalidity shall not affect the validity of.the remaining parts of this ordinance. ~he City Council hereby declares that it would have passed the remaining parts of this Ordinance if it had known that such part or parts thereof would be declared invalid. SECTION 4. The enactment of this Ordinance., being necessary to the immediate preservation of the public health., safety, property and to provide for the usual daily operation of a Municipal Department, it is declared to be an emergency measure which shall have and take effect following its present reading and adoption. SECTION 5. The City Secretary shall cause the publication of the caption and penalty clause of this Ordinance (said penalty dause being Section 2 of this Ordinance) once a week for two (2) consecutive weeks in a newspaper regularly published in the City of Lubbock as an alternative method of publication as provided by law.
