WHEREAS, the City Council finds that the alley portions as hereinafter described in the body of this Ordinance is no longer needed for alley purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW 1HEREFORE: BE IT ORDAINED BY THE CITY COUNCR. OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for alley purposes and for public use, such alley portions being more particularly described as follows: METES AND BOUNDS description of a portion of a 10 foot alley located Section in 28, Block E-2, Lubbock County, Texas and being previously recorded in Volume 1577, Page 512, Deed Records ofLubbock County, Texas, said portion being further described as follows: Beginning at a point in the South line ofLot 12, Westac Adddition, as recorded in Volume 4923, Page 8, Real Property Records ofLubbock County, Texas and in the North line of a 10 foot alley, recorded in Volume 1577, Page 512, Deed Records ofLubbock County, Texas, which point bears S. 00000'30" W., 1,360.51 feet and S. 8!1'59'00" E., 628.51 feet from the Northwest comer of Section 28, BlockE-2; · 1BENCE S. 8gc'59' E., along the North line of said 10 foot alley and the South line of said Lot 12, Westac Addition, a distance of365.33 feet to a point in the West right-of-way line of Loop 289, said point being the Northeast comer ofthis tract and the Southeast comer of said Lot 12, Westac Addition; nmNCE S. 20006'10" E., along said right-of-way line, a distance of 10.65 feet to a point for the Southeast comer of this tract and the Northeast corner of a 10.6397 acre tract, recorded in Volume 4010, Page 239, Real Property Records of Lubbock County, Texas; THENCE N. 8!1'59' W., along the North line of said 10.6397 acre tract and the South line of said 10 foot alley, a distance of368.99 feet to a point for the· Southwest comer of this tract and the Northwest comer of said 10.6397 acre tract; ~, ...... TIIENCE N. 00000'30" E. a distance oflO.OO feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City ofLubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City ofLubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
