HomeMy WebLinkAboutOrdinance - 10091-1998 - Zone Case2823 Zoning Change R-2 To GO - 08/27/1998First Reading Item Bo. 32 August 27. 1998 Second Reading Item Bo. 13 September 10. 1998 ORDINANCE NO. _ _...,:l=00=9=1::..-__ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2823; A ZONING CHANGE FROM R-2 TO GO ZONING ON A PORTION OF LAND OUT OF SECTION 14, BLOCK E-2, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; SUBJECT TO CONDITIONS; AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche- Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2823 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from R-2 to GO zoning district on a portion of land out of Section 14, Block E-2, City of Lubbock, Lubbock County, Texas, located north of 98th Street and east of Quaker Avenue, subject to the following condition and being further described as follows: BEGININNING at a point which is the Southwest corner of Lot 297, King's Gate Addition to the City of Lubbock as recorded in Volume 1856, Page 957 of the Deed Records of Lubbock County, same point bears North 89°59'05" East, 1005.11 feet and North 00°01'10" East, 55.00 feet from the Southwest II I I comer of Section 14, Block E-2 and the Northwest comer of Section 17, BlockE-2. THENCE North 8~59'05" East, along the South line of said Lot 297, a distance of 93.01 feet to a point of curvature to the left; THENCE Northeasterly, around a curve to the left, said curve having a radius of 15.00 feet, a central angle of 89°57'55", tangent lengths of 14.99 feet, a chord distance of 21.21 feet to a point in the West right-of-way line of Orlando Avenue; TIIENCE South 00001 '1011 West, along the West right-of-way line of said Orlando Avenue, at 69.98 feet pass the South line of said Section 14, same being the North line of said Section 17, in all a distance of 188.10 feet to a point of curvature to the right; THENCE Southwesterly, around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 68°56', tangent lengths of 10.30 feet, a chord distance of 16.98 feet to a point in the North right-of-way line of 98th Street; THENCE South 68°57'1 0" West, along the North right-of-way line of said 98th Street, a distance of 64.11 feet to a point of curvature to the right; THENCE Southwesterly, along the North right-of-way line of said 98th Street around a curve to the right, said curve having a radius of 899.93 feet, a central angle of 2°56'34", tangent lengths of 20.50 feet, a chord distance f 40.98 feet to a point which is the Southwest comer of this tract, same point being in the East line of an alley 20 feet in width; THENCENorth 00°01'10" East, along the East line of said alley, a distance of 223.94 feet to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITION: I. A brick pillar and wooden insert fence shall be constructed on the north property line with a step down toward Orlando. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/1 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance ofthe City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. Zone Case No. 2823 Page 2 of3 SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
