No. 2,Z' :fllii([.ts-~-,1998 ' Second Reading Item Ho. 10 August 13,. 1998 ORDINANCE NO ...... l.x.;OO.....,Zi...LZ_· __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2383-A; A ZONING CHANGE FROM A-1, C-2, R-1 AND R-2 TO AM, AM SPECIFIC USE ZONING AND C-2A ON A PORTION OF LAND OUT OF SECTION 22, BLOCK A, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City ofLubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on the proposed amendment, and the public hearing according to said notice, was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was determined by the City Council that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2383-A SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-24( c )(21) of the Code of Ordinances of the City of Lubbock from A-1, C-2, R-1 and R-2 to AM, AM Specific Use Zoning and C-2A on a portion ofland out of Section 22, Block A, City of Lubbock, Lubbock County, Texas, located between N. Loop 289 and Erskine and west of Quaker, subject to the following conditions and being further described as follows: SUBJECT TO THE FOLLOWING CONDITIONS: 1. Site plan review prior to a construction permit for the motel site. 2. Single story construction on proposed lots 1-3 along Erskine Avenue. TRACT ONE: PROPOSED LOTS 1-5 AM ZONING BEGINNING at a point in North line of Section 22, Block A, Lubbock County, Texas that bears East a distance of2308.6 feet from the Northwest comer of said section. THENCE East, along the North line of said Section 22, a distance of 1108.1 feet to the Northeast comer of this tract; · THENCE South, an approximate distance of 826.65 feet to a point in the North right-of-way line of North Loop 289; THENCE South 53°02' West, along the North right-of-way line of said North Loop 289, an approximate distance of 513.2 feet to a point; THENCE North, an approximate distance of 218.2 feet to a point of intersection with a curve; THENCE Northwesterly, around a curve to the right, said curve having a radius of 3 70 feet, a central angle of 41 °16'51", a chord bearing of North 65°38'26" West, an approximate chord distance of 305.22 feet; THENCE South 45° West, an approximate distance of 178.0 feet; THENCE West, an approximate distance of294.2 feet; THENCE North, an approximate distance of917.0 feet to the PLACE OF BEGINNING. TRACT TWO: PROPOSED LOT 6-AM SPECIFIC USE BEGINNING at a point which bears East, a distance of2308.6 feet and South a distance of917.0 feet from the Northwest comer of Section 22, Block A; THENCE East, an approximate distance of294.2 feet; THENCE North 45° East, an approximate distance of 178.0 feet to a point of intersection with a curve; THENCE Southeasterly, around a curve to the left, said curve having a radius of370 feet, a central angle of7°26'18", a chord bearing of South 45° East, an approximate chord distance of 48.0 feet; THENCE South 45° West, an approximate distance of 178.0 feet; THENCE South, an approximate distance of 462.8 feet to a point in the North right-of-way line of North Loop 289; THENCE South 53°02' West, along the North line of said North Loop 289, an approximate distance of 410.6 feet; THENCE North, an approximate distance of743.7 feet to the PLACE OF BEGINNING. Zone Case No. 2383-A Page2 TRACT THREE: PROPOSED LOT 7-C-2A ZONING BEGINNING at a point in the North right-of-way line of North Loop 289, said point bears East a distance of2636.66 feet and South 1413.74 feet from the Northwest comer of Section 22, Block A; THENCE North, an approximate distance of 462.8 feet; THENCE North 45° East, an approximate distance of 178.0 feet to a point of intersection with a curve; THENCE Southeasterly, around a curve to the left, said curve having a radius of 370.00 feet, a central angle of 41°16'51", a chord bearing of South 69°21 '35" East an approximate chord distance of260.9 feet; THENCE South, an approximate distance of218.2 feet to a point in the North line of North Loop 289; THENCE South 53°02' West, along the North right-of-way line of North Loop 289, an approximate distance of 463.1 feet to the PLACE OF BEGINNING. SECTION 2. THAT the granting of the specific use portion of this zoning is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification, which in this case is the A-1, C-2, R-1 and R-2 zone district; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. The Specific Use authorized by this Ordinance is permitted under provision of Section 29- 24(c)(21) of Codified Zoning Ordinance No. 7084 on the property described as a portion of land out of Section 22, Block A, City ofLubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
