AN ORDINANCE AMENDING ORDINANCE NO. 4139 SO AS TO REMOVE
CERTAIN CONDITIONS IMPOSED THEREBY; AMENDING ZONING ORDINANCE
NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO
MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1249: CHANGE LOTS 11.,
12, 13, 14, 15, 16, 17, 18, 19' AND 20, BLOCK 8, SYLVAN DELL HEIGHTS
ADDITION TO THE CITY OF LUBBOCK~ LUBBOCK COUNTY, TEXAS, FROM
"R-1" TO AN "R-3" ZONING DISTRICT; SUBJECT TO CONDITIONS.
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Council and after due consideration,
the City Conncil finds that making the proposed change as hereinafter set out
will be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695 as well
as notices provided by Article 1 Ollf, Vernon's Annotated Civil Statutes, amend-
ed in 1953, and notice was duly published in the Lubbock Morning Avalanche Jour-
nal more than fifteen (15) days prior to the date of the public hearing before the
City Council on such proposed amendment, and the public hearing according to saic
notice was duly held in the City Conncil Room on the second floor of the City Hall,
Lubbock, Texas, at which time persons appeared in support of the proposal; and,
after said hearing, it was by the City Conncil determined that it would be in the
public interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinance and this Ordinance having been introduced in final written form prior
to first reading hereof; and,
WHEREAS, the City Council finds it to be in the public interest to rerhove.

Addition to the City of Lubbock, Lubbock County, Texas; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 4139 be and is hereby amended by re-
moving certain conditions imposed by said Ordinance No. 4139 on Lots 1 through
10~ Block 8~ Sylvan Dell Heights Addition to the City of Lubbock, Lubbock County~
Texas; such conditions to be removed being as follows:
1. Apartments only shall be constructed on the property ..
2. 1500 square fe.et of lot area shall be provided for each apartment
unit.

3. One and one-half paved off ... street parking spaces shall be
provided for each dwelling unit.
SECTION 2. Change all of Lots 11~ 12~ 13~ 14~ 15~ 16, 17~ 18, 19 and 20,
Block 8, Sylvan Dell Heights Addition to the City of Lubbock~ Lubbock County,
Texas, from "R-.111 to "R-... 311 Zoning District; subject to the following conditions:
1. The development of the property shall be in accordance with
plan presented to the Planning and Zoning Commission~ filed
with the Secretary thereof for permanent record.
2. A planting screen shall be planted and maintained~ on the South
5t of the property~ which shall include shrubbery or trees and
shall be watered by an adequate sprinkler water system. This
planting screen shall also include a minimum 6[ high solid
permanent type screening fence which shall be permanently
maintained. There shall be no openings for ingress or egress
of vehicular traffic through this planting screen. Said fence
shall be sloped or "stepped down11 from a point 25r West of
the East property line to the East property line in order to
prevent obstruction to traffic view.
SECTION 3. THAT from and after passage and effective date of this Ordina e
said lots, tracts and parcels of land described in Section 1 hereof shall be changed
to the zoning district indicated and the Official Map is amended in accordance
herewith.
