HomeMy WebLinkAboutOrdinance - 10073-1998 - Zone Case 2816 Zoning Change From R-1 To R-1 Specific Use C-3 And GO - 05/28/1998l I First Reading Item No. 33 May 28, 1998 Second Reading Item No. 15 June 11, 1998 ORDINANCE NO. --'1=0:..:.07=3:...--__ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2816; A ZONING CHANGE FROM R-1 TO R-1 SPECIFIC USE, C-3 AND GO ZONING ON 78.395 ACRES OF LAND OUT OF SECfiON 4, BLOCK E, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City CoWlcil and, after due consideration, the City CoWlcil finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (V emon, 1990}, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City CoWlcil on the proposed amendment, and the public hearing according to said notice, was duly held in the City CoWlcil Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was determined by the City Council that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF TilE CITY OF LUBBOCK: ZONE CASE NO. 2816 SECTION 1. TI:IA T Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning Wlder the provisions of Section 29-24(c)(2) of the Code of Ordinances of the City of Lubbock from R-1 to R-1 Specific Use, C-3 and GO zoning on 78.395 acres of land out of Section 4, Block E, City of Lubbock, Lubbock County, Texas, located north of82nd Street and west of A venue P, and being further described as follows: TRACT ONE: Zoning Change from R-1 to R-1 Specific Use. Legal description for a zone change for a 65.93 acre tract of land located in the E/2 of the SE/4 of Section 4, Block E, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears North 00°02'11" West, 2639.82 feet from the Southeast comer of said Section 4, Block E; THENCE South 00°02'11 II East, along the East line of said Section 4, a distance of 1897.83 feet; THENCE South 89°57'49" West, a distance of 693.68 feet; THENCE South 00°02'11 II East, a distance of 510.28 feet; THENCE South 89°56'06" West, a distance of 628.09 feet to a point in the West line of said tract; THENCE North 00°00'51 II West, along the West line of said tract, a distance of 2409.25 feet to the Northwest comer of this tract; THENCE East, along the North line of said tract, a distance of 1320.83 feet to the PLACE OF BEGINNING. TRACT TWO: Zoning Change from R-1 to C-3 Legal description for a zone change of a 10.925 acre tract of land located in Section 4, Block E, Lubbock County, Texas, being further described by as follows: BEGINNING at a point which bears North 00°02'11" West a distance of 70.01 feet from the Southeast comer of Section 4, Block E, Lubbock County, Texas: THENCE West, a distance of30 feet to a point on a curve; THENCE Southwesterly, around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°02'11 ",a tangent length of 15.01 feet, a chord distance of 21.22 feet to a point of tangency; THENCE West, 55.00 feet from and parallel to the South line of said Section 4, a distance of 648.67 feet to a point; THENCE North 00°02'11 II West, a distance of686.56 feet to a point; THENCE North 89°57'49" East, a distance of 693.68 feet to a point in the East line of said Section 4; ZONE CASE NO. 2816 --PAGE2- I I THENCE South 00°02'11" East, along the East line of said Section 4, a distance of 671.99 feet to THE POINT OF BEGINNING. TRACT THREE: Zoning Change from R-1 to GO. Legal description for a zone change for a 2.54 acre tract of land located in Section 4, Block E, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears North 00°02'11" West, 55.00 feet and West, 718.68 feet from the Southeast comer of said Section 4, Block E; THENCE West, 55.00 feet from and parallel to the South line of said Section 4, a distance of 628.15 feet to a point in the West line of a 78.395 acre tract of land; THENCE North 00°00'51 II West, along the West line of said 78.395 acre tract of land, a distance of 175.57 feet to a point; THENCE North 89°56'06" East, a distance of 628.09 feet to a point; THENCE South 00°02' 11 II East, a distance of 176.28 feet to the PLACE OF BEGINNING. SECTION 2. THAT the granting of this specific use zoning is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification, which in this case is the R-1 zone district; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(2) of Codified Zoning Ordinance No. 7084 on the property described as 78.395 acres of land out of Section 4, Block E, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance ofthe City of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
