Second Reading Item #16 April 23, 1998 VOL 5819PAcr185 ORDINANCE NO. -=100=.::..:::66:..__ __ AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A DRAINAGE EASEMENT LOCATED IN SECTION 6, BLOCK B, LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that those portions of the drainage easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT those portions of the drainage easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, and being more particularly described as follows: METES AND BOUNDS DESCRIPTIONS of a portion of a drainage easement to be closed and abandoned, located in Section 6 Block B, Lubbock, Lubbock County, Texas, as recorded in Volume 583 Page 276 of the Deed Records of Lubbock County, Texas, being further described as follows: BEGINNING at a point 1320 feet south and 1980 feet east of the Northwest comer of Survey Six (6), Block B, Lubbock County, Texas; said point being 8 feet south of the Southeast comer ofLot One (1), Block Twelve (12), of the Berry Addition for the point of beginning; THENCE South a distance of 12 feet to a point of curvature; THENCE Southeasterly along a curve to the left (Radius of 151.85 feet, Tangent distance of 50 feet, and a central angle of36°27'4.8") a distance of96.60 feet to a point of tangency; THENCE South 36°27'4.8" East a distance of9.40 feet to a point of curvature; THENCE Southeasterly along a curve to the right (Radius of 151.85 feet, Tangent distance of 50 feet, and a central angle of36°27'4.8") a distance of96.60 feet to a point of tangency, said point being 1520 feet south and 2045 feet east of the Northwest comer of said Survey 6, Block B, Lubbock County, Texas; THENCE South a distance of 485 feet to a point; VOL 5819PAG£186 TIIENCE East a distance of 7I5 feet more or less to a point on the west line of Ivory Avenue as extended south from the Clutter Second Addition; THENCE South a distance of590 feet to a point; THENCE East a distance of 50 feet to a point; THENCE North a distance of I275 feet to a point 8 feet south of the Southwest corner of Lot One (I), Block Eleven (II) of said Clutter Second Addition; THENCE West a distance of 50 feet to a point 8 feet South of the Southeast corner ofLot Two (2), Block Ten (10), of said Clutter Second Addition; THENCE South a distance of 63 5 feet to a point; THENCE West a distance of665 feet to a point; THENCE North a distance of 435 feet to a point of tangency; THENCE along a curve to the left (Radius of201.85 feet, Tangent distance of 66.46 feet, and a central angle of36°27'4.8") a distance ofi28.4I feet to a point of tangency; THENCE North 36°27'4.8" West a distance of9.40 feet to a point of curvature; THENCE along a curve to the right (Radius of101.85 feet, Tangent distance of 33.54 feet, and a central angle of36°27'4.8") a distance of64.79 feet to a point; THENCE North I2 feet to a point, said point being 8 feet south and 50 feet east of the Southwest corner ofLot One (1), Block Twelve (12), ofthe Berry Addition to the City of Lubbock, Lubbock County, Texas; THENCE West a distance of 50 feet to the point of beginning; and containing 3.0298 acres, more or less. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. .... THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
