HomeMy WebLinkAboutOrdinance - 10064-1998 - Zone Case 2812 Zoning Change From R-2 To A-2 Church Related Activity - 03/26/1998First Reading Item #32 March 26, 1998 Second Reading Item #18 April 9, 1998 ORDmANCEN0. ___ 10_0_6_4 ____ __ AN ORDmANCE AMENDmG ZONmG ORDmANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKmG THE FOLLOWING CHANGES: ZONE CASE NO. 2812: A ZONmG CHANGE FROM R~2 TO A-2, ZONmG LIMITED TO CHURCH RELATED ACTIVITIES ON A PORTION OF LAND OUT OF SECTION 15, BLOCK E-2, SH RI DE HEIGHTS ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDmG A PENALTY; PROVIDmG A SAVmGS CLAUSE AND PROVIDmG FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to frrst reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2812 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from R-2 to A-2 zoning district on a portion of land out of Section 15, Block E-2, SH RI DE Heights Addition of Lubbock, Lubbock County, Texas, located at 4601 82nd Street, subject to the following condition and being further described as follows: 1. The use shall be limited to church and church related activities. Zone Case No. 2812 page-1 BEGINNING at a point from whence the northeast corner of Section 15, Block E- 2 bears East, a distance of 1584.0 feet; THENCE South a distance of 910.0 feet to a point; THENCE West a distance of 30.0 feet to a point in a curve to the left having a radius of 15.0 feet; THENCE along said curve to the left having a chord distance of 19.89 feet and a central angle of 83°06'28" to a point in a curve to the right having a radius of 360 feet; THENCE along said curve to the right having a chord distance of205.14 feet and a central angle of 33°06'28" to a point; THENCE North 50° West a distance of 75 feet to a point in a curve to the left having a radius of 420 feet; THENCE along said curve to the left having a chord distance of 263.94 feet and a central angle of 36°37'38" to a point in a curve to the left having a radius of 15 feet; THENCE along said curve to the left having a chord distance of 21.82 feet and a central angle of 93°22'22" to a point; THENCE West 60 feet to a point; THENCE North a distance of272.72 feet to a point in a curve to the left having a radius of 15 feet; THENCE along said curve to the left having a chord distance of 21.21 feet and a central angle of 90° to a point; THENCE North a distance of 60 feet to a point in a curve to the left having a radius of15 feet; THENCE along said curve to the left having a chord distance of 21.21 feet and a central angle of 90° to a point; THENCE North a distance of 250 feet to a point in a curve to the left having a radius of 15 feet; THENCE along said curve to the left having a chord distance of 21.21 feet and a central angle of 90° to a point; Zone Case No. 2812 page -2 THENCE North a distance of 55 feet to a point; THENCE East a distance of 625 feet to a POINT OF BEGINNING; SAVE AND EXCEPT a 2.69 acre tract of land dedicated as Tract "A", SH RI DE HEIGHTS, an Addition to the City of Lubbock, Lubbock County, Texas. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/1 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
