AUTHORIZING THE PLACING OF '3PEED LIMI'r SIGNS; l'RESCRffiiNG A !'mALTY; PROVIDING FOR PUBLICATION; AND DFXIT..A.RIN'G A.N EMERGENCY; AND PROVIDING FOR THE EFFF.CTlVE DATE OF THIS ORDINANCE. WHEREAS, the gov~ing body~ as authorized by Article g27a, Seco B, Vernon's Annotated Penal Code, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immedi ata preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth, which creates an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUB~OCK : SECTION 1. The prima facie speed limit established by Article B27a, See. g, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed for all vehicles to 35 miles per hour on the following designated highways or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit; On both sides of Quirt Avenue £rom Parkway Drive to the Idalou Highway. · SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance., SECTION J~ Any person, firm or corporation violating the prima facie speed limit established by this Ordi~nce shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLlARS {$200o00) and for subsequent viola- tions within one year thereafter shall be prosecuted as prescribed for such violations b,y Seco 15 of Article B27a, Vernon's Annotated Penal Code. SECTION 4o The City Secreta~ is authorized and directed to cause the publication of the descriptive caption of this Ordi.-~nce to~ether with the penalty provision as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is de- clared to be an emergency measure to take effect for and after its passage& AND IT IS SO ORDERED.
