AN ORDINANCE AMENDING ARTICLE VI OF CHAPTER 2 OF
THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS,
WITH REGARD TO THE PERMIT AND LICENSE APPEAL BOARD;
PROVIDING FOR MEETINGS, QUORUM AND VOTING.
Whereas, the City of LUBBOCK, Texas is a home-rule municipality
acting under its Charter duly adopted by the electorate pursuant to Article XI,
Section 5 ofthe Texas Constitution, as well as acting pursuant to Chapter 9 of the
Texas Local Government Code; and
Whereas, it is desirable to define the procedures by which meetings of the
City of Lubbock Permit and License Appeal Board shall be called; and
Whereas it is desirable to define for the City of Lubbock Permit and
License Appeal Board the voting requirements necessary to adopt a motion; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK
SECTION 1. THAT Section 2-165, Article VI of Chapter 2 ofthe Code
of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows:
Section 2-165. Meetings; quorum; voting.
A meeting of the Permit and License Appeal Board shall be specially
called as required upon receipt of a written notice of appeal by the office of the
City Secretary. The meeting to consider the appeal shall be held within such time
period as may be required under applicable provisions of the Code of Ordinances,
City of Lubbock, Texas, but not more than thirty (30) days after the timely filing
of the notice of appeal, unless a continuance ofthe meeting is granted by the
board for good cause shown , or unless a later date is requested or agreed to by the
appellant. The City Secretary or his representative shall notifY the board members
of the notice of appeal and a time and place for meeting of the board shall be set.
The City Secretary shall notifY the appellant by certified mail of the time and
place of meeting of the Permit and License Appeal Board to consider the appeal.
The presence of three (3) members of the board at a meeting shall constitute a
quorum. A motion may be adopted only if it receives the votes of at least a
majority of the members present at a properly called meeting where there is a
quorum present.
SECTION 2. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized and directed
to cause publication of the descriptive caption of this Ordinance as an alternative
method of publication.
