HomeMy WebLinkAboutOrdinance - 10053-1998 - Closing An Underground Utility Easement And Portion Storm Water Drainage. - 02/26/1998First Reading Item #13 February 26, 1998 8676 File And Return To Ed Bucy R-0-W Second Reading Item fill March 12. 1998 VOl 5768PACI251 ORDINANCE NO. 10053 AN ORDINANCE ABANDONING AND CLOSING AN UNDERGROUND UTU.ITY EASEMENT AND A PORTION OF A STORM WATER DRAINAGE AND· IMPOUNDMENT EASEMENT LOCATED IN THE PHEASANT RUN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF TinS ORDINANCE~ DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the underground utility easement and storm water drainage and impoundment easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCU. OF THE CITY OF LUBBOCK: SECTION 1. THAT the underground utility easement and storm water drainage and impoundment easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easements being more particularly described as follows: TRACT! An underground utility easement located in Tract D, Pheasant Run Addition to the City of Lubbock, Lubbock County, Texas, and being further described as follows: The East 20-feet of Tract D, Pheasant Run Addition to the City ofLubbock, Lubbock County, Texas. TRACT2 METES AND BOUNDS DESCRIPTION of a portion of a dedicated storm water drainage and impoundment easement located in Tract "A", Pheasant Run, an addition to the City of Lubbock, Lubbock County, Texas, according to the maps, plats, and/or dedication deeds thereof recorded in Volume 1947, Page 696, and Volume 2793, Page 214, Deed Records ofLubbock County, Texas, being further described as follows: COMMENCING at a 112" iron rod found at the Northeast comer of Tract "D" and the Northwest comer ofTract "A", Pheasant Run, an addition to the City of Lubbock, Lubbock County, Texas, same being a point in the South right-of-way line of 79th Street; THENCE Southwesterly around a curve to the left and along the East line of said Tract "011 and the West line of said Tract "A", said curve having a radius of375.00 feet, a central angle of23°47'53", tangent lengths of79.02 feet, and a chord distance of 154.64 feet to the POINT OF BEGINNING FOR TillS TRACT; THENCE S. 89°58'17" E. a distance of 123.31 feet to a point; THENCE S. 00°01'43'' W. a distance of298.47 feet to a point in the East line of said Tract "D" and the West line of said Tract "A"; THENCE Northwesterly around a curve to the right and along the East line of said Tract "D" and the West line of said Tract "A", said curve having a radius of606.72 feet, a central angle of 16°11'12", tangent lengths of86.28 feet, and a chord distance of 170.84 feet to a point of compound curvature being a common comer of said Tract "D" and said Tract "A"; THENCE Northwesterly around a curve to the right and along the East line of said Tract "D" and the West line of said Tract "A", said curve having a radius of375.00 feet, a central angle of24°11'35", tangent lengths of80.37 feet, and a chord distance of 15 7.17 feet to the POINT OF BEGINNING FOR TillS TRACT. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City ofLubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. Passed by the City Council on first reading this 26th day of February , 1998. Passed by the City Council on second reading this 12th day of March 1998.
