HomeMy WebLinkAboutOrdinance - 10049-1998 - Zone Case 2807 Zoning Change R-1 To C-4 Section 16 Block E-2 - 01/22/1998First Reading Item #32 January 22, 1998 ' Second Reading Item /116 February 12, 1998 ORDINANCE NO.--L.l1 O.u.O.r.:4...;c..9 ---- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2807; A ZONING CHANGE FROM R-1 TO C-4 ON A PORTION OF LAND OUT OF SECTION 16, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2807 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29 of the Code of Ordinances of the City of Lubbock from R-1 to C-4 on a portion of land out of Section 16, Block E-2, City of Lubbock, Lubbock County, Texas, lm:ated South of 98th Street and East of Slide Road, subject to the following conditions, and being further described as follows: METES AND BOUNDS description for a 7.7 acre tract ofland out of Section 16, Block E-2, Lubbock County, Texas, being further described as follows: Zone Case No. 2807 page -1- BEGINNING at a point from whence the Northwest comer of Section 16, Block E-2 bears North 0°03'27" West, 660.00 feet and South 89°59'17" West, 55.00 feet; THENCE North 89°59'1711 East, a distance of330.0 feet; THENCE South 00°03'27" East, a distance of 1482.42 feet; THENCE North 89°59'09" West, a distance of 330.00 feet; THENCE North 00°03'27" West, a distance of 1482.24 feet to the PLACE OF BEGINNING. Subject to the following eonditions: 1. That a site plan, including building elevations showing materials, color, texture and a detailed landscape plan shall be submitted to the Planning and Zoning Commission for approval prior to the issuance of a building permit. 2. That the site plan review process shall include a review of proposed curb cuts with the objective of reducing the total number between lOlst and I 07th Streets. 3. That the following are permitted uses as a condition of approval as per the strike list. A. Any use conditionally or unconditionally permitted in the "C-2A", "C-2" or "C-3" Districts. B. Ambulance service. C. Automobile body shops, outside storage limited to customer vehicles only. D. Automobile brake shop. E. Automobile glass shop. F. Automobile seat cover and upholstery shop. G. Automobile transmission shop. H. Automobile and recreational vehicles sales and service (may include body and paint shop, as accessory use). Zone Case No. 2807 page-2- I. Barber and beauty shop supply dealer. J. Boat and boat trailer sales and service. K. Candy plant. L. Canvas goods shop, tents and awnings (no manufacturing). M. Commercial private clubs and teenage clubs. N. Electrical equipment repairs. 0. Feed store with no grinding, packaging, or mixing of feed permitted. P. Frozen food lockers. Q. Furniture store, used. (All merchandise must be in a building). R. Garage, public, repair. (Outside storage of customer automobiles authorized.) All work and separate parts shall be inside a building. S. Garden center. T. Gasoline service station. (Business permitted outside of building and outside displays of products permitted within three (3) feet of the building.) U. Greenhouse and plant nursery. V. Hotel or motel. W. Hot tamale plant. X. Janitorial or cleaning service. Y. Job printing and lithographing. Z. Magazine agency. AA. Motorcycle shop, including sales, rentals and service. BB. Muffler shop. CC. Nonprofit training centers with retail sales. Zone Case No. 2807 page -3- DD. Pest control service. EE. Print shop. FF. Produce market. GO. Rental store. HH. Rental store, heavy equipment and trailers only. II. Reserved. JJ. Restaurants. (Business permitted outside of building). K.K. Restaurants, with the sale of alcoholic beverages as an incidental use, except that no mixed alcoholic beverage sales shall be made or delivered to occupants in motor vehicles. LL. Secondhand goods store or pawnshop. MM. Swimming pool, commercial or sales. (Business permitted outside building). NN. Upholstery shop~Furniture. 00. Veterinary hospital (totally within a building). PP. Wholesale house, sales office and storage-No cotton storage. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
