AN ORDINANCE AMENDING ORDINANCES NO. 1695 AND NO. 2924 SO M
TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 795-A: AMEND ORDIN
ANCE NO. 2924 BY REMOVING!!\ CONDITION IMPOSED THEREON FOR LOTS
10. AND 11, BLOCK 3. WESTMINIST.ER HEIGHTS ADDITION TO THE CITY OF
LUBBOCK. LUBBOCK <DUNTY. TEXAS.
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Council and after due consideration,
the City Council finds that making the proposed change as hereinafter set out will
be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendmen
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices
provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1953,
and notice was duly published in the Lubbock Morning Avalanche Journal more tha ~
fifteen {15) days prior to the date of the public hearing according to said notice wa
duly held in the City Council Room on the second floor of the City Hall, Lubbock,
Texas, at which time persons appeared in support of the proposal; and, after said
hearing, it was by the City Council determined that it would be in the public interEst,
due to changed conditions, that the Zoning Ordinance and the Zoning Map be a}'Ylen ed
in the manner hereinafter set forth in the body of this Ordinance and this Ordinanc e
having been introduced in final written form prior to first reading hereof; NOW~
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT Ordinance No. 2924 be and the same is hereby amended by deleting
the contlition therefrom which reads as follows:
111. That only one duplex be constructed on the two lots", so that the
said condition will not attach to the property described as Lots 10,
and 11, Block 3, Westminister Heights Addition to the City of Lub-
bock, Lubbock County, Texas.
And in lieu thereof provide as follows:
"That the property covered and described in Zone Case 795-A be
developed in accordance with the site plan on file in the office of
the Secretary of the Planning and Zoning Commission which is
hereby adopted and made a part hereof. 11
AND IT IS SO ORDERED.
Passed by the City Council on first reading this 4th day of June , 1964.
Passed by the City Council on second reading this 30th day of June , 1964. -----·
