SPEED LIMIT ON BOTH SIDES OF SLATON OAD (U.S. 84) BEGINNING 0. 250 MILES SOUTHEAST FROM THE TRAFFIC IRCLE AND EXTENDING SOUTHEAST FOR o. 600 MILES; AUTHORIZING THE LACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR UBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRO- IDING THAT STREET OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN HALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS OR- INANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT RDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PRO IDING A SAVINGS CLAUSE; DECLARING AN EMERGENCY; AND PROVIDING FO HE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS., the governing body of the City of Lubbock. as authorized by rticle 670ld., Section 169 (b) Vernon1s Texas Civil Statutes. finds that certain rima facie speed limits on certain highways are different from what is reasonable r safe and should be altered and the immediate preservation of public health and afety requires immediate alteration of said prima facie speed limits as hereafter et forth, which creates an emergency., NOW THEREFORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 6701d_. ection 166 (a) 1 -Vernonts Texas Civil Statutes is altered and changed for all ehicles to thirty-five ( 35) miles per hour on the following designated highway or treet in the corporate limits of the City of Lubbock, Lubbock County.~~ Texas, to-wi : .. On the West side of Avenue Q (u.s. 84) beginning at the intersection of 29th Street and 'extending South to the intersection of 41st Street. On the East side of Avenue Q ( U,. s. 84) beginning at the intersection of 29th Street and extending South to the intersection of 38th Street. SECTION 2. The prima facie speed limit established by Article 670ld~ ection 166 (a) 1 -Vernon1s Texas Civil Statutes is altered and changed for all ehicles to forty ( 40) miles per hour on the following designated highway or street i he corporate limits of the City of Lubbock. Lubbock County~ Texas~ to-wit: On the West side of Avenue Q (U.S,. 8 4) beginning at the intersection of 41st Street and extending South for o. 791 miles. On the East side of Avenue Q (U .. s. 84) beginning at the intersection of 38th Street and extending South for o. 9 7 7 miles. SECTION 3,. The prima facie speed limit established by Article 670ld, ection 166 (a) 1 -Vernon1s Texas Civil Statutes is altered and changed for all ehicles to forty-five ( 45) miles per hour on the following designated highway or treet in the corporate limits of the City of Lubbock,. Lubbock County:. Texas to- it: On the West side of Avenue Q South Drive {u.s. 84) beginning at a point o. 791 miles South of 41st Street and extending Southeast for o. 422 miles. On the East side of Avenue Q South Drive {U. s. 84) beginning at a point o. 977 miles South of 38th Street and extending Southeast for o. 422 miles. SECTION 4. The prima facie speed limit established by Article 6701d~ ection 166 {a) 1 -Vernonts Texas Civil Statutes is altered and changed for all ehicles to fifty (50) miles per hour on the following designated highway or street in he corporate limits of the City of Lubbock. Lubbock County~ Texas, to-wit: On both sides of Avenue Q South Drive {u.s. 84) beginning at a point 1. 213 miles South of 41st Street and extending Southeast for 0. 325 m miles. On both sides of the Slaton Road {u.s. 84) beginning at the Traffic Circle and extending Southeast for o. 250 miles. / SECTION 5. The prima facie speed limit established by Article 6701d~ ection 166(a) 1 -Vernonts Texas Civil Statutes is altered and changed for all ehicles to sixty ( 60) miles per hour on the following designated highway or street i he corporate limits of the City of Lubbock~ Lubbock County~ Texas., to-wit: On both sides of the Slaton Road (U.s. 84} beginning at a point o. 250 miles Southeast from the Traffic Circle and e xtending Southeast for o. 600 miles. SECTION 6. The City Manager is authorized and directed to cause the lacing of signs so as to clearly define the limits of the prima facie areas set out n this Ordinance. SECTION 7. Any person, firm or corporation violating the prima facie peed limit established by this Ordinanc-e shall upon conviction be fined any sum not o exceed TWO HUNDRED ($200.00) DOLLARS and for subsequent violations within ne year thereafter shall be prosecuted as prescribed for such violations by Section 5 of Article 827a~ V.ernonts Annotated Penal Code. SECTION a. The City Secretary is authorized and directed to cause the ublication of the descriptive caption of this Ordinance together with the penalty pro ision as an alternative method of publication as provided by law. SECTION 9. That all Ordinances or parts of Ordinances conflicting with ny of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 10. All highways or streets not specifically set forth in the receding sections hereof shall not be affected by the provisions hereof, and this Or inance shall be cumulative of all other prima facie speed limit Ordinances e xcept hose with which it specifically conflicts. SECTION 11. Should any section~ paragraphJO sentence~ clause, phrase r word of this Ordinance be declared unconstitutional or invalid for any reasons, th emainder of this Ordinance shall not be affected thereby. SECTION 12. The fact that public necessity and convenience requires hat this Ordinance be passed as an emergency measure for reasons set forth in the reamble hereof, the rule requiring that no Ordinance shall be finally passed on the ay of its introduction be suspended, and this Ordinance be declared to be an emer- ency measure to take effect from and after its passage.
