I File And Return To Ed Bucy R-O-W 7393 ORDINANCE NO. __;;;1_;;;,;02=2:_1 __ Second Reading Nov. 11, 1999 Item No. 12 VOL 6599PAGE 56 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF AVENUE G, TWO 15-FOOT ALLEYS, AND A PORTION OF A 20-FOOT ALLEY LOCATED IN THE MORNING SIDE ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, ALL OF WHICH ARE MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO frnFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the CifX Council fmds that the street and alleys as hereinafter described in the body of this Ordinance are no longer needed for street and alley purposes and public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for street and alley purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street and alleys as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street and alley purposes and for public use, such street and alleys portions being more particularly described as follows: TRACT ONE A portion of Avenue "G" located in Section 7, Block B, Lubbock County, Texas, being further described as follows: BEGINNING at a 60 penny nail with cap set in the North right-of-way line of 27th Street for the Southeast comer of this tract, which is the original Southwest comer of Lot 10, Block 2, Morning Side Addition to the City of Lubbock, Lubbock County, Texas; THENCE West, along said North right-of-way line, a distance of50.00 feet to a "cross" cut in concrete for the original Southeast comer of Lot 6, Block 3, Morning Side Addition and the Southwest comer of this tract; THENCE North, along the East line of said Block 3, a distance of 200.00 feet to a 60 penny nail with cap set for the original Northeast comer of Lot 3, Block 3, Morning Side Addition and the Northwest comer this tract; THENCE East a distance of 50.00 feet to a "crow's foot" cut in concrete in the West line of Block 2, Morning Side Addition for the Northeast comer of this tract; THENCE South, along the West line of said Block 2, a distance of 200.00 feet to the Point ofBeginning. •. TRACT TWO VOL6599rAGE 57 A 15-foot alley located in Section 7, Block B, Lubbock County, Texas, being further described as follows: BEGINNING at a "cross" cut in concrete in the North right-of-way line of 27th Street for the Southwest comer of this tract, which is the original Southeast comer ofLot 7, Block 3, Morning Side Addition to the City ofLubbock, Lubbock County, Texas; TIIENCE North, along the East line ofLots 7-8, Block 3, a distance of90.60 feet to a "crow's foot" cut in concrete in the Southeast right-of-way line oflnterstate Highway 27 for the Northwest corner of this tract; THENCE Northeasterly along said right-of-way line around a curve to the right, said curve having a radius of2864.79 feet, a central angle of01°01'55", a chord bearing ofN. 16°54' E. and a chord distance of 51.60 feet to a brass right-of-way marker found in the West line of Lot 4, Block 3; TIIENCE South, along the West line ofLots 4-6, Block 3, a distance of 139.97 feet to a "cross" cut in concrete in the North right-of-way line of 27th Street for the original Southwest comer ofLot 6, Block 3 for the Southeast comer of this tract; TIIENCE West, along said North right-of-way line, a distance of 15.00 feet to the Point of Beginning. TRACT THREE A 15-foot alley located in Section 7, Block B, Lubbock County, Texas, being further described as follows: BEGINNING at a concrete nail with cap set in the Nmth right-of-way line of 28th Street for the Southwest corner of this tract, which is the original Southeast corner ofLot 7, Block 4, Morning Side Addition to the City of Lubbock, Lubbock County, Texas; TIIENCE North, along the East line of Lots 7-12, Block 4, a distance of300.11 feet to a concrete nail with cap set in the South right-of-way line of 27th Street for the original Northeast corner ofLot 12, Block 4 and the Northwest comer of this tract; TIIENCE East, along said South right-of-way line, a distance of 15.00 feet to a concrete nail with cap set for the original Northwest corner of Lot 1, Block 4; TIIENCE South, along the \Vest line ofLots 1-6, Block 4, a distance of300.11 feet to a concrete nail with cap set in the North right-of-way line of 28th Street for the original Southwest corner ofLot 6, Block 4 for the Southeast corner of this tract; THENCE West, along said North right-of-way line, a distance of 15.00 feet to the Point of Beginning. • .. VOL 6599PAG£ 58 TRACT FOUR A portion of a 20-foot alley located in Section 7, Block B, Lubbock County, Texas, being further described as follows: BEGINNING at a concrete nail with cap set in the East right-of-way line of Avenue "G" for the Southwest comer of this tract, which is the original Northwest comer of Lot 10, Block 2, Morning Side Addition to the City of Lubbock, Lubbock County, Texas; THENCE North, along said East right-of-way line, a distance of20.00 feet to a concrete nail with cap set for the Northwest comer of this tract; THENCE East a distance of200.00 feet to 112" rod with cap set for the Northeast comer of this tract; THENCE South a distance of20.00 feet to a 112" rod with cap set for the original Northeast comer of Lot 13, Block 2, Morning Side Addition for the Southeast comer of this tract; THENCE West, along said North line of Lots 13-10, Block 2, a distance of200.00 feet to the Point of Beginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. • . ..
