PAR-.T-1_0_F_T_H_E __ \V BUILDING CODE OF VOLUME ll OF THE LUBBOCK CITY CODE BY ENLARGING )9'/ THE BOARD OF EXAMINERS AND APPEALS FROM FIVE MEMBERS TO SIX -{)-MEMBERS AND FURTHER PROVIDING FOR THEIR RESPECTIVE TERMS OF 5 OFFICE TO BE SIX YEARS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE., WHEREAS~ it now appears to the City Council of the City of Lubbock that the present membership of the Board of Examiners and Appeals as provided for in the Building Code now consisting of five members should be increased to a six ... man membership in order to better expedite the matters coming before the said Board of Examiners and Appeals; and, WHEREAS., it further appears to the City Council that under the present ordi ... nance that the members of the Board of Examiners and Appeals shall be appointed by the City Council and shall hold office for an indefinite time; and., WHEREAS, it appears to be an imposition and a hardship on the members of this Board to serve for an indefinite term and in order to alleviate this hardship a definite term of office should be provided for as early as possible, NOW THEREFO .E: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 304~ Chapter 3. Part 1 of the Building Code of the Lubbock City Code be and the same is hereby amended as follows: "In order to determine the suitability of alternate materials and types of construction and to provide for reasonable interpretations of the provisions of this Code,. there shall be and is hereby created a Board of Examiners and Appeals, consisting of .Aix. members who should whenever practicable be chosen from among architects,. builders,. lawyers .. structural engineers and/or other persons qualified by experience and training to pass upon matters pertaining to building construction. The Building Inspector shall be an ex officio member and shall act as Secretary of the Board. The Board of Examiners and Appeals shall be appointed by the City Council and shall hold office for a term of six years, except that two of the members first appointed shall hold office for terms of two years.,. ending June 1, 1966, two members shall hold terms of office of four years, ending June 1~ 1968, and the other two members shall hold terms of office of six years., ending June 1., 1970,. the respective terms of the first members appointed shall be as determined by the City Council, and thereafter their successors shall hold office for six years and until their successors are appointed. "The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing -' . to the Building Inspector with a duplicate copy to the Appellant and may recommend to the City Council such new legislation as is consistent therewith. "The Board of Examiners and Appeals may interpret the provisions of this Code to cover a special case~ if it appears that the provisions of this Code do not definitely cover the point raised or that a manifest injustice might be done~ provided that every such decision shall be by unanimous vote of the Board of Examiners and Appeals. Decisions as to the use of alternate materials and/or types of construction shall be by majority vote and if expressly prohibited by this Code shall become effective only when authorized by an amendment to this Code. 11 SECTION 2. All ordinances or parts of ordinances inconsistent with this ordinance are hereby repealed. SECTION 3. The terms of this ordinance shall take effect from and after its passage.
