Manufactured Homes - 10/28/1999First Reading Oct. 28, 1999 Item No. 33 Second Reading Nov. 4, 1999 Item No. 9 ORDINANCE NO . ..:.10=2=0=-9 __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2860; A ZONING CHANGE FROM R-1 TO R-1 SPECIFIC USE ZONING FOR MANUFACTURED, MODULAR AND SITE BUILT HOMES ON BLOCKS 1-8, LOTS 1-20 EACH BLOCK, SUN LAWN ADDITION; LOTS 1-56, KELLEY ADDITION; LOTS 1-19, HARLANDALE ADDITION; BLOCK 7, LOTS 1-24, EC MURRAY ADDITION; LOTS 1-24, FARRIS COLBERT ADDITION; LOTS 1-20, BUENAS CASAS ADDITION; BLOCK 1, LOTS 1,2,3,5,6, TRACTS 1-A,C,C-1, BLOCK 4, LOTS 1-8, TRACTS A,B,E, BLOCK 6A, LOTS 1- 12,BLOCK 6B, LOTS 1-12, RIX ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; SUBJECT TO CONDITIONS, PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council fmds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code 211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on the proposed amendment, and the public hearing according to said notice, was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was determined by the City Council that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2860 SECTION I. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-24(c)(1) of the Code of Ordinances of the City of Lubbock from R-1 to R-1 Specific Use for manufactured, modular and site built homes on Blocks 1-8, Lots 1-20 each blocl{, Sun Lawn Addition; Lots 1-56, Kelley Addition; Lots 1-19, Harlandale Addition; Block 7, Lots 1-24, EC Murray Addition; Lots 1-24, Farris Colbert Addition; Lots 1-20, Buenas Casas Addition; Block 1, Lots 1,2,3,5,6, Tracts 1-A,C,C-1, Block 4, Lots 1-8, Tracts A,B,E, Block 6A, Lots 1-12, Block 6B, Lots 1-12, Rix Addition, City of Lubbock, Lubbock County, Texas, located south of East Broadway and east of Guava, and subject to the following conditions: SUBJECT TO THE FOLLOWING CONDITIONS: 1. The property and the structure must be under common ownership. 2. The area under the structure shall not be used for storage of any kind. Said area shall be completely enclosed. 3. Manufactured homes placed in this district shall not be more than ten (10) years old at the time of siting. 4. Have the main entry door facing the street on which the home is located, except when the home qualifies for a perpendicular or diagonal placement on the lot. The home must be oriented on the Jot so that its long axis is parallel with the street. A perpendicular or diagonal placement may be permitted if there is a building addition so the narrow dimension of the home, as so modified and facing the street, is no less than fifty (50) percent of the home's long dimension. A paved walkway shall be installed connecting the front door to the street, driveway or sidewalk that is adjoining neighboring lots. 5. Have a gable or hip roof of at least 3 in 12 or greater and covered with material that is residential in appearance, including, but not limited to, approved wood, asphalt composition or fiberglass shingles, but excluding corrugated metal and corrugated fiberglass. 6. Have an exterior surface and window treatment that to the maximum extent possible are architecturally compatible with those of neighboring properties. Exterior surfaces shall not be smooth, ribbed or corrugated metal or plastic panels. The exterior covering must be uniform in materials, color, texture, grain and appearance and must extend the full length of the wall all the way to the ground, except that when a solid concrete or masonry perimeter foundation is used, the exterior covering material need not extend below the top of the foundation. Brick, rock or stucco, extending from at least the bottom of the structure to the ground will be considered an appropriate substitute for the required uniform exterior covering. 7. Have any tongue and running gear including axles removed. 8. Have a permanent set of steps leading to a permanent porch or landing that is a minimum of twenty-five (25) square feet in area, with the smallest dimension being no less than three (3) lineal feet, set at each exterior door. Each porch, landing, and stairs must provide guardrails and handrails complying with the building code as adopted by the City of Lubbock. SECTION 2. THAT the granting of this specific use zoning is hereby made subject to compliance with all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Coditied Zoning Ordinance, which provides that a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification, which in this case is the R-1 zone district; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(1) of Codified Zoning Ordinance No. 7084 on the property described as Blocks 1-8, Lots 1-20 each block, Sun Lawn Addition; Lots 1-56, Kelley Addition; Lots 1-19, Harlandale Addition; Block 7, Lots 1-24, EC Murray Addition; Lots 1-24, Farris Colbert Addition; Lots 1-20, Buenas Casas Addition; Block 1, Lots 1,2,3,5,6, Tracts 1-A,C,C-1, Block 4, Lots 1-8, Zo11e Case No. 1860 Page1of3 Tracts A,n,E, Block 6A, Lots 1-12,Block 6n, Lots 1-12, Rix Addition. City of Lubbock. Lubbock County. Texas. SECTION 3.
