HomeMy WebLinkAboutOrdinance - 10202-1999 - Zone Case 2497-B Zoning Change From R-1 To IHC - 09/23/1999First: Reading Sept:. 23, 1999 Item llo. 41 II Second Reading Oct:. 14. 1999 Item llo. 21 ORDINANCE N0. __ 10_2_0_2 __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2497-B; A ZONING CHANGE FROM R-1 TO IHC ZONING ON A PORTION OF LAND OUT OF SECTION 11, BLOCK A, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS, PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2497-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from R-1 to IHC zoning district on a portion of land out of Section 11, Block A, City of Lubbock, Lubbock County, Texas, located north of north Loop 289 and east of University. Subject to conditions and being further described as follows: Metes and Bounds description for a zone change request only for a 15.625 acre tract of land in Section 11, Block A, Lubbock County, Texas, being further described as follows: BEGINNING at a point in the East right-of-way line of North University Avenue which bears N. 00°05' E., 1319.35 feet and S. 89°49'55" E., 40.05 feet from the Southwest comer of Section 11, Block A, Lubbock County, Texas; THENCE S. 89°49'55" E., an approximate distance of 616.3 feet; THENCE S. 00°26'25" W., an approximate distance of 1159.9 feet to a point in the North right-of-way line of Loop 289; THENCE N. 83°53'40" W., along the North right-of-way line of said Loop 289 an approximate distance of 420.28 feet; THENCE Northwesterly, around a curve to the right, said curve having a radius of 215.00 feet, a central angle of 68°06', tangent lengths of 145.29 feet, a chord bearing ofN. 49°50'40" W., an approximate chord distance of240.76 feet; THENCE N. 00°19'35" W., along the East right-of-way line of North University Av'enue, an approximate distance of 961.7 feet to the Place of Beginning. SUBJECT TO THE FOLLOWING CONDITIONS: 1. IHC limited to the following uses: a. Manufactured home sales facility(ies) b. All C-3 permitted uses c. Hotel or motel d. Wholesale house e. Veterinary office or clinic f. Garden center g. Greenhouse or plant nursery 2. For any manufactured home sales facility other than the Clayton Homes lot, a site plan shall be reviewed by the Planning Commission with notice to adjacent owners, and the new facility shall conform with the intent outlined in #3 below. 3. The Clayton facility shall be developed consistent with graphics included in the Zone Case 2497-B f'IIe. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/100 Dollars Zone Case No. 2497-B page-2 of3 ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
