HomeMy WebLinkAboutOrdinance - 10195-1999 - Amending Chapter 12 Adopting Texas Food Establishment Rules - 09/09/1999First: Reading Sept: .. 9, 1999 Item Bo. 34 II Second Reading Sept:. 23, 1999 Item Bo. 15 ORDINANCE NO. 10195 ------ AN ORDINANCE AMENDING CHAPTER 12 OF THE CITY OF LUBBOCK CODE OF ORDINANCES, ADOPTING THE TEXAS FOOD ESTABLISHMENT RULES; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock has adopted the sanitation rules adopted by the Texas Board of Health on November 30, 1977; and WHEREAS, the Texas Department of Health has revised and updated the above- described rules; and WHEREAS, the City Council finds that it would be expedient and in the interest of the public health, safety and general welfare to adopt the revised rules; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 12-18 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: "Sec. 12-18. Adoption ofFood Establishment Rules. The 'Texas Food Establishment Rules' adopted by the Texas Department of Health on October 6, 1998, as amended, are hereby incorporated into this article by reference and food sanitation within the city shall be enforced and regulated in accordance with said rules. A copy of said rules shall be. filed with the city secretary and a copy maintained in the office of Environmental Inspection Services, which said copies shall be available for public inspection during the business hours of the offices in which they are maintained." SECTION 2. THAT this Ordinance shall be advisory only until October I, 2000, at which time it shall become enforceable. During the advisory time period, the Health Department shall train food establishments under the new Texas Food Establishment Rules. The current rules which were adopted by the Texas Board of Health November 30, 1977, shall remain in effect and enforceable until the advisory period is ended. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. I ; AND IT IS SO ORDERED.
