HomeMy WebLinkAboutOrdinance - 10194-1999 - Closing A Temporary Construction And Overhead Electrical Easement Vol 5253 - 09/09/1999First Reading Sept. 9. 1999 Item No. 16 II 35066 file And Return To Ed Bucy R-0-W V~L 6440PA{;f255 Second Reading Sept. 23, 1999 Item No. 14 ORDINANCE NO. 10194 AN ORDINANCE ABANDONING AND CLOSING A TEMPORARY CONSTRUCTION AND OVERHEAD ELECTRICAL EASEMENT RECORDED IN VOLUME 5253, PAGE 51 OF THE OFFICIAL REAL PROPERTY RECORDS OF LUBBOCK COUNTY AND LOCATED IN SECTION 28, BLOCK E-2, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICA TON. WHEREAS, the City Council finds that the easement as hereinafter described in the body of this Ordinance is no longer needed for easement purposes and public use and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described as follows: BEGINNING at a point which bears S. 00°07'26" W. a distance of 30.00 feet and N. 89°57'59" W. a distance of22.00 feet from the Northeast comer of the Northwest 114 of Section 28, Block E-2; THENCE S. 00°07'26" W. a distance of approximately 299.98 feet to a point; THENCE S. 00°01 '56" W. a distance of approximately 922.04 feet to a point; THENCE S. 09°45'19" E. a distance of approximately 121.90 feet to a point; THENCE S. 89°59'24" W. a distance of approximately 10.59 feet to a point on a curve to the right; THENCE along said curve to the right a chord distance of 121.81 feet to a point. Said curve having a radius of368.55 feet and a chord bearing N. 09°28'46" W; THENCE N. 00001 '56" E. a distance of approximately 922.05 feet to a point; THENCE N. 00°07'26" E. a distance of299.97 feet to a point; ! ' . VOL 644 0PAGE256 THENCE S. 89°57'59'• E. a distance of 10.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
