HomeMy WebLinkAboutOrdinance - 10179-1999 - Zone Case 1977-F Changing From GO To C-2A Section 27 Block E-2 - 08/12/1999First Read:f.ng Aug. 12. 1999 Item Bo. 66 Second Read:f.ng Aug. 26. 1999 Item No. 14 ORDINANCE N0.___;1=0=1=79;.__ __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1977-F; A ZONING CHANGE FROM GO TO C-2A ZONING ON 2.02 ACRES OF LAND OUT OF SECTION 27, BLOCK E-2, LUBBOCK, TEXAS; PROVIDING A PENALTY; SUBJECT TO CONDITIONS, PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber ofthe Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1977-F SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from GO to C-2A zoning district on 2.02 acres of land out of Section 27, Block E-2, City of Lubbock, Lubbock County, Texas, located north of 73rd Street and west of Slide, subject to the following conditions and being further described as follows: Metes and bounds description for a zone change request for a 2.02 acre tract of land located in Section 27, Block E-2, Lubbock County, Texas being further described as follows: Beginning at a point that bears North 2842.13 feet and West 60.00 feet from the Southeast corner of Section 27, Blcok E-2, same point being in the West right-of-way line of Slide Road and a point of curvature to the right; THENCE Southwesterly, around a curve to the right, said curve having a radius of 15.00 feet a central angle of 90°06', tangent lengths of 15.03 feet, a chord distance of 21.23 feet to a point in the North right-of-way line of 73n1 Street; THENCE N. 89°54' W., along the North right-of-way line of 73n1 Street, a distance of 336.97 feet to a point in the West right-of-way line of a 20 foot alley; Thence North, along the West right-of-way line of said alley, a distance of 250.00 feet; THENCE S. 89°54' E., 250 feet from and parallel to the North right-of-way line of 73 rd Street a distance of 352.00 feet to a point in the West right-of-way line of Slide Road; Thence South, along the West right-of-way line of Slide Road, a distance of 234.97 feet to the place of Beginning. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Tied to site plan #1977-F, with the exception of signage. Proposed signs shall comply with the Zoning Code. 2. Eight (8) foot high cedar screening fence along the West side of the property attached to steel posts. 3. Five (5) foot high masonry screening fence along the south line of the property with an opening for the standard driveway entrance onto 73n1 Street. Five (5) foot high fence stops approximately 105 feet from east property line on Slide Road with a pedestrian opening. Five (5) foot high masonry fence continues east to a point that is approximately 43 feet from the east property line on Slide Road. 4. Seven (7) foot high cedar screening fence with steel posts and a concrete footing along the west property line of Lots 274,275 and 288, Spanish Oaks Addition. 5. To reduce glare, the direction of light from wall and parking lot lighting fixtures will be emphasized. Zone Case No. 1977-F page-2 of3 SECTION 2. THAT violation of any provision ofthis Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/1 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THATshould any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
