I ORDINANCE NO. _10_1_:._76..;___ I AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO WASTEWATER REGULATIONS AND ENFORCEMENT; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. ! I WHEREAS, the City Council of the City of Lubbock deems it to be in the best interests l of the health, safety and welfare of the citizens of the City of Lubbock to make the following I amendments to Chapter 28 of the Code of Ordinances of the City of Lubbock, Texas; NOW I. THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I SECTION 1. THAT Subsection 28-124(c) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (c) The City shall annually publish, as required by and in accordance with the provisions of 40 CFR Part 403.8(f)(2)(vii), EPA, in the largest daily newspaper in Lubbock a list of industrial users which, at any time during the previous twelve ( 12) months, were in significant noncompliance with applicable pretreatment requirements. The notification shall also summarize any enforcement action taken against the industrial users during the same twelve (12) months. SECTION 2. THATSubsection 28-137(a) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (a) The administrative procedure to address noncompliance with this chapter shall be as follows: (1) Depending on the severity of the noncompliance, the initial notification shall be one of the following: phone call, letter of concern, or warning notice requiring correction of the situation within a period often (1 0) to thirty (30) days as specified by the inspector. (2) Depending on the severity of the noncompliance, the second notification will be one of the following: warning notice, or violation notice requiring correction of the situation within a period often (10) to thirty (30) days as specified by the inspector. (3) Depending on the severity of the noncompliance, the third notification will be one of the following: violation notice requiring correction of the situation within a period of ten (1 0) days as specified by the inspector, or issuance of a citation for violation of this chapter if such noncompliance has not been corrected. 'I ( 4) Issuance of a citation for violation of this chapter if noncompliance I has not been corrected. / SECTION 3. THAT violation of any provision of this Ordinance shall be deemed to be a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock, Texas. SECTION 4. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
