AN ORDINANCE ordering a bond election to be held in the City of Lubbock,
Texas, making provision for the conduct of the election and resolving other matters
incidental and related to such election.
WHEREAS, the City Council of the City of Lubbock, Texas hereby finds that an
election should be held to determine whether said governing body shall be authorized to
issue bonds of said City in the amounts and for the purposes hereinafter identified; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS:
SECTION 1: An election shall be held on the 18th day of September, 1999, in the
City of Lubbock, Texas, which date is not less than fifteen (15) nor more than ninety (90)
days from the date of the adoption hereof and the holding of the election on such date
rather than on a uniform election date is hereby found to be in the public interest. At
such election, the following measures shall be submitted:
PROPOSITION NO. 1
"SHALL the City Council of the City ofLubbock, Texas, be
authorized to issue general obligation bonds of the City in the principal
amount of $17,165,000 for permanent public improvements and public
purposes, to wit: street improvements, including drainage, curb, gutters,
landscaping, sidewalks; curb ramps and utility line relocation and the
acquisition of land and right-of-way therefor; such bonds to mature
serially or otherwise over a period not to exceed FORTY (40) years from
their date, to be issued and sold in one or more series at any price or prices
and to bear interest at any rate or rates (fixed, floating, variable or
otherwise) as shall be determined within the discretion of the City Council
at the time of issuance or sale of the bonds; and whether ad valorem taxes
shall be levied upon all taxable property in the City sufficient to pay the
annual interest and provide a sinking fund to pay the bonds at maturity?"
PROPOSITION NO. 2
"SHALL the City Council of the City ofLubbock, Texas, be
authorized to issue general obligation bonds of the City in the principal
amount of$2,160,000 for permanent public improvements and public
purposes, to wit: drainage improvements; such bonds to mature serially or
otherwise over a period not to exceed FORTY (40) years from their date,
to be issued and sold in one or more series at any price or prices and to
bear interest at any rate or rates (fixed, floating, variable or otherwise) as

issuance or sale of the bonds; and whether ad valorem taxes shall be levied
upon all taxable property in the City sufficient to pay the annual interest
and provide a sinking fund to pay the bonds at maturity?"
PROPOSITION NO. 3
"SHALL the City Council of the City of Lubbock, Texas, be
authorized to issue general obligation bonds of the City in the principal
amount of $3,295,000 for permanent public improvements and public
pmposes, to wit: traffic signalization and assorted communications
equipment; such bonds to mature serially or otherwise over a period not to
exceed FORTY ( 40) years from their date, to be issued and sold in one or
more series at any price or prices and to bear interest at any rate or rates
(fixed, floating, variable or otherwise) as shall be determined within the
discretion of the City Council at the time of issuance or sale of the bonds;
and whether ad valorem taxes shall be levied upon all taxable property in
the City sufficient to pay the annual interest and provide a sinking fund to
pay the bonds at maturity?"
PROPOSITION NO. 4
"SHALL the City Council of the City of Lubbock, Texas, be
authorized to issue general obligation bonds of the City in the principal
amount of $14,765,000 for permanent public improvements and public
pmposes, to wit: to acquire or improve, or both, land for park pmposes,
such bonds to mature serially or otherwise over a period not to exceed
FORTY (40) years from their date, to be issued and sold in one or more
series at any price or prices and to bear interest at any rate or rates (fixed,
floating, variable or otherwise) as shall be determined within the
discretion of the City Council at the time of issuance or sale of the bonds;
and whether ad valorem taxes shall be levied upon all taxable property in
the City sufficient to pay the annual interest and provide a sinking fund to
pay the bonds at maturity?"
PROPOSITION NO. 5
"SHALL the City Council of the City of Lubbock, Texas, be
authorized to issue general obligation bonds of the City in the principal
amount of $475,000 for permanent public improvements and public
purposes, to wit: a multiple pmpose regional arts center; such bonds to
mature serially or otherwise over a period not to exceed FORTY (40)
years from their date, to be issued and sold in one or more series at any
price or prices and to bear interest at any rate or rates (fixed, floating,
variable or otherwise) as shall be determined within the discretion of the
City Council at the time of issuance or sale of the bonds; and whether ad
valorem taxes shall be levied upon all taxable property in the City

sufficient to pay the annual interest and provide a sinking fund to pay the
bonds at matwity?"
SECTION 2: Electronic optical scan voting system shall be used in the election
and ballots shall be prepared in accordance with the applicable provisions of the Election
Code so the voters may cast their ballots either "FOR" or "AGAINST" the aforesaid
measures which shall appear on the ballot substantially as follows:
PROPOSITION NO. 1
"THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE
AMOUNT OF $17,165,000 FOR STREET IMPROVEMENTS"
PROPOSITION NO. 2
"THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE
AMOUNT OF $2,160,000 FOR DRAINAGE IMPROVEMENTS"
PROPOSITION NO. 3
"THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE
AMOUNT OF $3,295,000 FOR TRAFFIC SIGNALIZATION"
PROPOSITION NO. 4
"THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE
AMOUNT OF $14,765,000 FOR PARK IMPROVEMENTS"
PROPOSITION NO. 5
"THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE
AMOUNT OF $475,000 FOR A REGIONAL ARTS CENTER"
The Central Counting Station for the tabulation and counting of ballots for this
election shall be located at the Lubbock County Courthouse, 904 Broadway, Lubbock,
Texas, and the persons hereby appointed to serve as Manager, Tabulation Supervisor, the
Presiding Judge and Alternate Presiding Judge at the Central Counting Station are as
follows:

The Manager and Presiding Judge of the Central Counting Station may appoint
clerks to serve at such Station, as provided by Section 127.006 of the Election Code.
SECTION 3: The City shall be divided into forty-eight ( 48) election precincts for
this election and the polling places designated for each election precinct and the persons
hereby appointed to serve as Presiding Judge and Alternate Presiding Judge for each
polling place are shown in Exhibit "A", which is attached hereto and incorporated herein
by reference as a part hereof for all purposes.
Each Presiding Judge shall appoint not less than two (2) nor more than six (6)
qualified clerks to serve and assist in holding said election; provided that if the Presiding
Judge herein appointed actually serves, the Alternate Presiding Judge shall be one of the
clerks.
On election day, the polls shall be open from 7:00A.M. to 7:00P.M.
The sealed ballot box procedure established by Subchapter C, Chapter 127,
V.T.C.A., Election Code, shall be used for this election.
Early voting shall be conducted at the City Secretary's office in the City Hall,
1625 13th Street, Room 206, Lubbock, Texas, in accordance with the provisions of
V.T.C.A., Election Code. Early voting for this election shall begin Wednesday,
September 1, 1999 and end Tuesday, September 14, 1999, and the hours designated for
early voting by personal appearance shall be from 8:00A.M. to 5:00P.M. on each day,
except Saturdays, Sundays and official State holidays.
The Presiding Judge for the Early Ballot Board shall be Joy Lambert, who shall
appoint at least two other members to serve on the Early Ballot Board for this election in
accordance with Section 87.002, V.T.C.A., Election Code.
Additionally, six (6) temporary branch offices for early voting by personal
appearance shall be established at the locations identified in Exhibit B attached hereto
and incorporated herein by reference as a part of this Ordinance for all purposes. Early
Voting Clerks for early voting at such temporary branch offices and the dates and hours
for early voting at such offices are specified in the attached Exhibit B.
SECTION 4: All resident qualified electors of the City shall be permitted to vote
at said election, and on the day of the election, such electors shall vote at the polling
place designated for the Election Precinct in which they reside. This election shall be
held and conducted in accordance with the provisions of V.T.C.A., Election Code and
Chapter 1 of Title 22, V.A.T.C.S., and as may be required by law, all election materials
and proceedings shall be printed in both English and Spanish.

SECTION 5: A substantial copy of this ordinance shall serve as proper notice of
said election. Said notice, including a Spanish translation thereof, shall be posted at three
(3) public places within the City and at the City Hall not less than fourteen (14) full days
prior to the date on which said election is to be held, and be published on the same day in
each of two successive weeks in a newspaper of general circulation in said City, the frrst
of said publications to appear in said newspaper not more than thirty (30) days and not
less than fourteen (14) full days prior to the day of the election.
