BLOCK E-2, LUBBOCK COUNTY,. TEXAS. FROM AN "R-1 11 TO A "C-211 ZONING DISTRICT: SUBJECT TO CONDITIONS. WHEREAS. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recomm dation~ which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS. all conditions precedent required by law for a valid amendin t to the Zoning Oriiinance and Map have been fully complied with, as well as givin notices in compliance with Section 20 of Ordinance No. 1695 and as well as notices provided by Article lOilf, Vennon1s Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche Journ more than fifteen (15) days prior to the date of the public hearing aefore the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the propos and, after said hearing, it was by the City Council determined that it would be · the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereofi NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows., to-wit: ZONE CASE NO. 1067 Change a tract of land out of the NW Corner of Section 12, Block E-2, Lubbock County, Texas, further described by metes and bounds to-wit: BEGINNING at a point·5301 South and 551 East of the NW Corner of said Section 12; THENCE East 6051 to a point; THENCE South 7901 to a point; THENCE West 6051 to a point; THENCE North 7901 to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: . -1.. The minimum building setbacks as follows: 1301 from Indiana Avenue 38 t from the north property line sot from the property line dividing said tract from the residential lot (Northeast corner) sot from Hartfo~d Avenue 20r from the South property line Except that where a service station may be built on the property it may be constructed to within 43r of the street property line with such setback requirements in include pumps .. canopies and pylon or free ... standing signs in addition to the main building. 2. Maximum building areas shall be 121,000 square feet or such area as will maintain a 3:1 parking area to building area ratio. 3. Visual screening shall be provided along the north property line; and along the east property line dividing said tract from the residential lot. The north ... south distance shall be from the north property line of said tract to the setback line of the residential lot to the east., from which point the screening shall angle 45° in a southwesterly direction to a point 12t west of the property line, and extend south and parallel to the west right ... of ... way line of Hartford to the south property line of said tract. The visual screening shall be accomplished by a permanent seven foot solid visual screening wall or fence to be constructed to its full length or extent as required above prior to or concurrently with the first unit of any building construction on said tract of land. 4. Ornamental planting shall be installed and maintained along Hartford Avenue between the curb and the screening fence., along the east side of the property., in such a manner as to prevent a hazard to motor vehicles. 5. Uses shall be restricted to those permitted in a nc ... 2A" district. 6. Building height shall not exceed one story. 7. One pylon type sign shall be permitted along the west frontage provided such sign is set back a minimum of 6Qt from Indiana Avenue and does not exceed 45t in height and 640 square feet in area.. All other signs shall be restricted to those permitted in the 11C ... 211 district. 8. Sidewalks of st minimum width shall be constructed along the property line parallel to Indiana Avenue. 9. Driveways for ingress and egress shall be approved by the City Traffic Engineer under the terms of the Cityts Driveway Ordinance regulating construction of driveways. . 10. The owner of the property described herein shall grant a twenty (20) foot utility easement along and parallel to the south property line of such tract describeq here, and shall also grant to the city of Lubbock an easement to collect garbage from the said tract. In addition, all utilities service to the said property shall be approved by the Director of Public Works of the City of Lubbock. 11. Lighting of the property area shall be shielded and/ or directed to prevent glare on adjacent residentially used areas. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots. tracts and parcels of land described in Section 1 hereof shall be-changed to the zoning district indicate d and the Official Map is amende< in accordance herewith.
