Second Reading June 30. 1999 Item No. 3 ORDINANCE NO. 10168 AN ORDINANCE AMENDING SECTION 8-4 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ESTABLISHING VOTING PRECINCT BOUNDARIES IN NEWLY ANNEXED AREAS; CORRECTING THE BOUNDARIES OF EXISTING VOTING PRECINCTS AFFECTED BY ANNEXATION; ESTABLISHING VOTING DISTRICT BOUNDARIES IN NEWLY ANNEXED AREAS; CHANGING THE NAME OF A POLLING PLACE DUE TO A CHANGE IN BUILDING OWNERSIDP; PROVIDING A MAP OF THE VOTING PRECINCTS AND POLLING PLACES OF THE CITY OF LUBBOCK; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Lubbock recently annexed into the City an area of I 0.4I square miles contiguous with the City pursuant to Ordinance No. I 0 I17, which annexation was not objected to by the U.S. Department of Justice on March 29, I999; and WHEREAS, Section 42.06I of the Texas Election Code mandates that city voting precinct boundaries conform to county voting precinct boundaries except where the city limits prevent conformance; and WHEREAS, certain changes to the Lubbock County voting precinct lines within the City of Lubbock have been made due to the annexation by the Lubbock County Commissioners on May 26, I999; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 8-4 of the Code of Ordinances of the City of Lubbock, Texas, be amended as follows with regard to the named City voting precincts: Voting Precinct No. 52. Beginning at the intersection of 82nd Street and Indiana A venue; thence east along 82nd Street to its intersection with University A venue; thence south along University Avenue to its intersection with 98th Street; thence east along 98th Street to its intersection with Avenue P; thence south along Avenue P to a point 660 feet south of the centerline of 98th Street; thence west along a line (the city limits) 660 feet south of the centerline of 98th Street to a point 660 feet south and 660 feet east of the intersection of the centerlines of 98th Street and University Avenue; thence south along a line (the city limits) 660 feet east of the centerline ofUniversity Avenue to a point 660 feet south and 660 feet east of the intersection of the centerlines of University A venue and 114th Street; thence west along a line (the city limits) 660 feet south of the centerline of 114th Street to its intersection with Indiana Avenue; thence north along Indiana Avenue to the point of beginning. The voting place shall be All Saints School. Voting Precinct No. 54. Beginning at the intersection of 82nd Street and Quaker A venue; thence east along 82nd Street to its intersection with Indiana A venue; thence south along Indiana A venue to its intersection with 98th Street; thence west along 98th Street to its intersection with Quaker A venue; thence north along Quaker A venue to the point of beginning. The voting place shall be Honey Elementary School. Voting Precinct No. 55. Beginning at the intersection of Frankford Avenue and 82nd Street; thence east along 82nd Street to its intersection with Slide Road; thence south along Slide Road to its intersection with 98th Street; thence west along 98th Street to its intersection with Frankford A venue; thence north along Frankford A venue to the point of beginning. The voting place shall be Smith Elementary School. Voting Precinct No. 57. Beginning at the intersection of Alcove A venue and 19th Street; thence east along 19th Street to its intersection with Milwaukee A venue; thence south along Milwaukee Avenue to its intersection with the Lehman Branch of the P. &.S. F. railroad; thence northwest along the Lehman Branch ofP. & S. F. railroad to a point 150 feet west of the centerline of Milwaukee A venue; thence south along a line parallel to and 150 feet west of the centerline of Milwaukee A venue to its intersection with the Seagraves Branch of P. & S. F. railroad; thence southwest along the Seagraves Branch of the P. & S. F. railroad to a point 660 feet west of the centerline of Milwaukee Avenue; thence north along a line parallel to and 660 feet west of the centerline of Milwaukee A venue to a point 660 feet south and 660 west of the intersection of the centerlines of 34th Street and Milwaukee A venue; thence west along a line 660 feet south the centerline of 34th Street to its intersection with Alcove Avenue; thence north along Alcove A venue to the point of beginning. This precinct will be combined with precinct Number 53 for voting purposes and the voting place shall be Lubbock Christian University. Voting Precinct No. 66. Beginning at the intersection of 82nd Street and Slide Road; thence east along 82nd Street to its intersection with Quaker A venue; thence south along Quaker A venue to its intersection with 98th Street; thence west along 98th Street to its intersection with Slide Road; thence north along Slide Road to the point of beginning. The voting place shall be Lakeridge Methodist Family Ministry Center. Voting Precinct No. 73. Beginning at the intersection ofChica~o Avenue and 66th Street; thence south along Chicago A venue to its intersection with 82n Street; thence west along 82nd Street to a point 660 feet west of Milwaukee A venue; thence north along a line parallel to and 660 feet west of the centerline of Milwaukee A venue to its intersection with the Seagrave Branch of the P. & S. F. railroad; thence northeast then curving northwest along the Seagrave Branch of the P. & S. F. railroad to its intersection with Lehman Branch of the P. & S. F. railroad: thence east along the Lehman Branch of P. & S. F. railroad to its intersection with Loop 289: thence southwest along Loop 289 to its intersection with Frankford Avenue; thence south along Frankford Avenue to its intersection with 66th Street; thence east along 66th Street to the point of beginning. The voting place shall be Crestview Elementary School. Voting Precinct No. 78. Beginning at the intersection of 82nd Street and Milwaukee A venue; thence east along 82nd Street to its intersection with Frankford Avenue; thence south along Frankford Avenue to its intersection with 98th Street; thence west along 98th Street to its intersection with Milwaukee A venue; thence north along Milwaukee Avenue to the point of beginning. The voting place shall be Smith Elementary School. 2 Voting Precinct No. 104. Beginning at the intersection of 82nd Street and Upland Avenue; thence north along Upland Avenue to its intersection with the north right-of-way line ofU. S. Highway 62; thence northeasterly along the north right of way line ofU. S. Highway 62 to a point 660 feet west of the west section line of Section 36 Block AK; thence south along a line parallel to and 660 feet west of the west section lines of Section 36 and 29 Block AK to its intersection with 82nd Street; thence west along 82°d Street to the point of beginning. The voting place shall be consolidated with the nearest permanent voting location until such time as a suitable public building becomes available and population increase requires the establishment of a permanent voting location. Voting Precinct No. 1 05. This precinct has been incorporated into Precinct No. 11I and is deleted from the list of voting precincts. Voting Precinct No. I06. This precinct has been incorporated into Precinct No. II 0 and is deleted from the list of voting precincts. Voting Precinct No. 109. Beginning at the intersection oflndiana Avenue and 98th Street; thence south along Indiana A venue to a point 660 feet south of the centerline of I 14th Street; thence west along a line (the city limits) parallel to and 660 feet south of the centerline of 1I4th Street to its intersection with Quaker Avenue; thence north along Quaker A venue to its intersection with 98th Street; thence east along 98th Street to the point of beginning. The voting place shall be consolidated with the nearest permanent voting location until such time as a suitable public building becomes available and population increase requires the establishment of a permanent voting location. Voting Precinct No. II 0. Beginning at the intersection of 98th Street and Quaker A venue; thence south along Quaker A venue to a point 660 feet south of the centerline of I 14th Street; thence west along a line (the city limits) parallel to and 660 feet south of the centerline of 114th Street to its intersection with Slide Road; thence north along Slide Road to its intersection with 98th Street; thence east along 98th Street to the point of beginning. The voting place shall be consolidated with the nearest permanent voting location until such time as a suitable public building becomes available and population increase requires the establishment of a permanent voting location. Voting Precinct No. 111. Beginning at the intersection of 98th Street and Slide Road; thence south along Slide Road to a point 660 feet south of the centerline of I 14th Street; thence west along a line (the city limits) parallel to and 660 feet south of the centerline of I 14th Street to a point 660 feet south and 55 feet west of the intersection of the centerlines of I 14th Street and Alcove Avenue; thence north along a line (the city limits) 55 feet west and parallel to the centerline of Alcove Avenue to its intersection with the north right-of-way line ofU. S. Highway 62; thence northeasterly along the north right-of-way line ofU. S. Highway 62 (the city limits) to its intersection with Upland Avenue; thence south along Upland Avenue to its intersection with 98th Street; thence east along 98th Street to the point of beginning. The voting place shall be consolidated with the nearest permanent voting location until such time as a suitable public building becomes available and population increase requires the establishment of a permanent voting location. Voting Precinct No. 112. Beginning at a point that is 660 feet south and 660 feet west of the intersection of the centerlines of 34th Street and Milwaukee Avenue; thence 3 south along a line parallel to and 660 feet west of the centerline of Milwaukee Avenue to its intersection with the north right-of way line ofU. S. Highway 62; thence southwesterly along the north right-of-way line ofU. S. Highway 62 to a point 660 feet west of the centerline of Upland Avenue; thence north along a line (the city limits) parallel to and 660 feet west of the centerline of Upland Avenue to a point 660 feet south of the centerline of 34th Street; thence east along a line parallel to and 660 feet south of the centerline of 34th Street to the point of beginning. The voting place shall be consolidated with the nearest permanent voting location until such time as a suitable public building and population increase requires the establishment of a permanent voting location. SECTION 2. THAT the name of the polling place for City Voting Precinct No. 66 be corrected to read as "Lakeridge Methodist Family Ministry Center" instead of "Wayland Baptist University" due to a change in ownership of the building. SECTION 3. THAT the Code of Ordinances ofthe City of Lubbock, Texas, BE and is hereby amended by amending the descriptions of Voting Districts No.4 and No.5 contained in Subsection 8-4(b) to read as follows: Voting District No. 4-Precincts Nos. 12, 30, 48, 52, 54, 60, 61, 67, 74, 75, 94, 107 and 109. Voting District No. 5-PrecinctNos. 27, 53, 55, 57, 62, 66, 73, 78, 96, 104, 110, 111 and 112. SECTION 4. THAT the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended by deleting Subsection 8-4(c) and substituting therefor the following: (c) The voting precincts and voting districts set out in this section shall be delineated on a map denominated "City of Lubbock Voting Precincts/Districts Official Map/Effective January 1, 2000." A copy of said official map is attached to and made a part of this Section as if fully copied herein in detail. A copy of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said official map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 5. THAT all portions of Chapter 8 of the Code of Ordinances of the City of Lubbock not hereinabove altered shall remain as they are. SECTION 6. THAT should any paragraph, section, sentence, clause, phrase of word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. 4 !
