HomeMy WebLinkAboutOrdinance - 10157-1999 - Zone Case 2843, Zone Change C-2 & R-1 To C-3, C-2 Sec 28 - 04/22/1999First Reading Item Ho. 47 April 22, 1999 Second Reading Item #16 Hay 13. 1999 ORDINANCE NO. 10157 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2843; A ZONING CHANGE FROM C-2 and R-1 TO C-3 and C-2 ZONING ON three tracts of land out of Section 28, Block AK, LUBBOCK, TEXAS; PROVIDING A PENALTY; SUBJECT TO CONDITIONS, PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, the 1986 Comprehensive Land Use Plan is a guide to help the Lubbock Planning and Zoning Commission and City Council determine the physical development of the community; however, planning is a continuous process and change is inevitable; and WHEREAS, the Lubbock Planning and Zoning Commission and City Council recognize that the zone change on three tracts of land out of Section 28, Block AK, City of Lubbock, Lubbock County, Texas, is a minor deviation from the 1986 Comprehensive Land Use Plan and attempt to protect public and private commitments that have been previously based on the Plan; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2843 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from C-2 and R-1 to C-3 and C-2 zoning district on three tracts of land out of Section 28, Block AK, City of Lubbock, Lubbock County, Texas, located south of 82nd Street and west of Frankford. Subject to the following conditions and being further described as follows: TRACT 1 METES AND BOUNDS DESCRIPTION for a zone change request from R-1 to C-2 for a tract of land located in the Northeast one-third of Section 28, Block AK, Lubbock, Lubbock County, Texas, being further described as follows: Beginning at a point in the West line of the Northeast one-third of Section 28, Block AK which bears N. 89°54'20" W., 264.70 feet and S. 00°02'50" E., 55.00 feet from the Northeast comer of said Section 28, same point being in the South right-of-way line of 82nd Street; THENCE S. 89°54'20" E., along the South right-of-way line of said 82nd Street, a distance of 175.13 feet to a point which is the Northeast comer of this tract; THENCE S. 00°01'35" E., a distance of 343.05 feet to a point which is the Southeast comer of this tract; THENCE N. 89°54'20" W., a distance of 175.00 feet to a point in the West line of the Northeast one-third of said Section 28 for the Southwest comer of this tract; THENCE N. 00°02'50" W., a distance of343.05 feet to the place of Beginning; Contains 1.377 acres of land, more or less. TRACT2 Metes and bounds description for a zone change request from R-1 to C-3 for a tract of land located in the Northeast one-quarter of Section 28, Block AK, Lubbock County, Texas, being further described as follows: Beginning at a point which is N. 89°54'20" W., 1,500.00 and S. 00°01 '35" E., 55.00 feet from the Northeast comer of Section 28, Block AK, said point being in the South right-of-way line of 82nd Street; THENCE S. 00°01 '35" E., a distance of 343.05 feet to a point in the North line of a 20 foot alley dedicated in Volume 4652, Page 28 of the Real Property Records of Lubbock County, Texas; THENCE N. 89°54'20" W., a distance of966.55 feet to a point for the Southwest comer of this tract; THENCE N. 00°01 '35" W., a distance of343.05 feet to a point in the South right- of-way line of 82nd Street for the Northwest comer of this tract; Zone Case No. 2843 page-2 of4 THENCE S. 89°54'20" E., along the South line of said 82nd Street right-of-way, a distance of966.55 feet to the place of Beginning. Contains 7.611 acres of land, more or less. TRACT3 Metes and bound description for a zone change request from C-2 to C-3 for a tract of land located in the Northeast comer of Section 28, Block AK, Lubbock County, Texas, being further described as follows: Beginning at a point which is N. 89°54'20" W., 1,500.00 and S. 00°01 '35" E., 55.00 feet from the Northeast comer of Section 28, Block AK, said point being in the South right-of-way line of 82nd Street; THENCE S. 8~54'20" E., along the South right-of-way line of82nd Street, a distance of 175.00 feet to a point which is the Northeast comer of this tract; THENCE S. 00°01 '35" E., a distance of 342.68 feet to a point in the North line of a 20 foot wide alley dedicated in Volume 4652, Page 28, of the Real Property Records of Lubbock County, Texas; THENCE N. 89°58'25" W., along the North line of said 20-foot alley, a distance of 175.00 feet to a point for the Southwest comer of this tract; THENCE N. 00001 '35" W., a distance of 343.05 feet to the place of beginning; Contains 1.377 acres of land more or less. SUBJECI' TO THE FOLLOWING CONDffiONS: 1. That the zoning on Tract 1 is changed from R-1 to C-2 zoning district; and 2. That the zoning on Tract 2 is changed from R-1 to C-3 zoning district; and 3. That the zoning on Tract 3 is changed from C-2 to C-3 zoning district; and 4. That the property on Tracts 1, 2, and 3 shall have no more than one curb return for each 100 feet along 82nd Street. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
