AN ORDINANCE ABANDONING AND CLOSING A 15-FOOT ALLEY IN BLOCK 4 OF THE C.C. LEFTWICH SUBDIVISION THE CITY OF LUBBOCK AND A PORTION OF NORFOLK AVENUE AND 15m STREET ADJACENT TO BLOCK 4 OF THE C.C. LEFTWICH SUBDIVISION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICA TON. WHEREAS, the City Council finds that the street and alley portions hereinafter described in the body of this Ordinance are no longer needed for street and alley purposes and public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street and alley portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street and alley purposes and for public use, such street and alley portions being more particularly described as follows: TRACT ONE A 15-foot alley to be closed in Block 4 of C. C. Leftwich Subdivision to the City of Lubbock, Lubbock County, Texas, being further described by bounds as follows: Beginning at a point which is the Southeast comer of Lot 1, Block 4 of said C.C. Leftwich Subdivision to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 415, Page 456, Deed Records ofLubbock County, same point being the Northeast comer of said 15 foot alley ·and being in the West right-of-way line ofNorfolk Avenue; THENCE South, bounded by the West right-of-way line of said Norfolk Avenue, a distance of 15.00 feet to a point which is the Northeast comer of Lot 24, Block 4 of said C. C. Leftwich Subdivision and the Southeast comer of said alley; THENCE West, bounded by the North lot lines ofLots 24 through 13 of said Block 4 of C.C. Leftwich Subdivision, same being the South line of said alley, a distance of600.00 feet to a point which is the Northwest corner of said Lot 13 and the Southwest comer of said alley, same point being in the East right-of-way line of Orlando Avenue; THENCE North, bounded by the East line of said Orlando Avenue, a distance of 15.00 feet to a point which is the Southwest comer ofLot 12, Block4, of said C. C. Leftwich Subdivision and the Northwest comer of said alley; THENCE East, bounded by the South lot lines ofLots 12 through I, Block 4 of said C.C. Leftwich Subdivision, same being the North line of said alley, a distance of600 feet to the place of Beginning. TRACT TWO A portion ofNorfolk Avenue and 15th Street to be closed adjacent to Block 4 of C. C. Leftwich Subdivision to the City of Lubbock, Lubbock County, Texas, being further described by bounds as follows: Beginning at a point in the West right-of-way line ofNorfolk Avenue which is the Southeast comer of Lot 24, Block 4, of said C.C. Leftwich Subdivision to the City of Lubbock, same point being in the North right-of-way line 16th Street; THENCE North, bounded by the East Lot line of said Lot 24, Block 4, the East line of a 15 foot alley and the East lot line ofLot 1, Block 4 of said C. C. Leftwich, a distance of 291.60 feet to a point which is the Northeast comer of said Lot I same being a point in the South right-of-way line of 15th Street; THENCE West, bounded by the South lot lines ofLots I through 8 of said Block 4, along the South right-of-way line of said 15th Street, a distance of378.99 feet to a point 28.99 feet West of the Northeast comer of said Lot 8, same being the intersection of the projection of the East right-of-way line of Orlando Avenue; THENCE North, bounded by the projection of the East right-of-way line of said Orlando Avenue, a distance of 57.63 feet to a point which is in the original North right-of-way line of 15th Street; THENCE East, bounded by the original right-of-way line of 15th Street, a distance of 378.99 feet to a point which is the intersection of the East right-of-way line ofNorfolk Avenue, same point being the Northwest comer of Lot A, C. C. Leftwich Subdivision to the City of Lubbock; THENCE South, bounded by the East line of said Norfolk Avenue and the West lot line of said Lot A, a distance of344.64 feet to a point which is the intersection of the projection of the North right-of-way line of 16th Street; THENCE West, bounded by the projection of the North line of said 16th Street, a distance of60.00 feet to the place ofBeginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, 1 showing the number of this Ordinance and the date of its final passage. 2 . - SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. · AND IT IS SO ORDERED.
