HomeMy WebLinkAboutOrdinance - 2001-O0108 - Closing A Portion 20 Ft Underground Easement Section 8 Block E-2 - 12/13/2001First Reading December 13, 2001 Item No. 29 Fil@ And ~£,turn io Ed Sucy R-0-W 3~'5:t ORDINANCE NO. 2001-00108 i Second Reading January 10, 2002 Item 12 VOL 7 4 73 PAcr204 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A 20 FOOT UNDERGROUND UTILITY EASEMENT LOCATED IN SECTION 8, BLOCK E-2, LUBBOCK COUNTY, TEXAS, AND A 10 FOOT SEWER LINE EASEMENT LOCATED IN SECTION 8, BLOCK E-2, LUBBOCK COUNTY, TEXAS, MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the underground utility easement and the 10 foot sewer line easement as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the underground utility easement and the 10 foot sewer line easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement portions being more particularly described as follows: METES AND BOUNDS DESCRIPTION of a portion of a 20 foot underground utility easement to be closed located in Section 8, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at cross on concrete found in the East right-of-way line of Quaker A venue at the Southwest corner of Lot 82, Drury Park, an addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 1074, Page 29, Deed Records of Lubbock County, Texas for the Northwest corner of this tract; THENCE East, along the South line of said Lot 82, a distance of 150.00 feet to a ½" iron rod found at the Southeast corner of said Lot 82, Drury Park, for an interior corner of this tract; THENCE North, along the East line of said Lot 82, a distance of 3.88 feet to a point; THENCE East a distance of 465.00 feet to the Southwest corner of Lot 10, Drury Park, an addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 742, Page 213, Deed Records of Lubbock County, Texas, same being a point in the East line of that tract of land described in Volume 6018, Page 316, Real Property Records of Lubbock County, Texas, for the Northeast corner of this tract; ._, VDl 7 4 73PAG£205 THEN CE South a distance of 20. 00 feet to the Northwest corner of Lot 11, Drury Park, for the Southeast corner of this tract; THENCE West a distance of 615.00 feet to a point in the East right-of-way line of Quaker A venue for the Southwest corner of this tract; THENCE North, along the East right-of-way line of Quaker Avenue, a distance of 16.12 feet to the Point of Beginning. METES AND BOUNDS DESCRIPTION of a sewer line easement to be closed located in Section 8, Block E-2. Lubbock County, Texas, being further described as follows: BEGINNING at cross on concrete found in the East right-of-way line of Quaker A venue at the Southwest corner of Lot 82, Drury Park, an addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat, and/or dedication deed thereof recorded in Volume 107 4, Page 29, Deed Records of Lubbock County, Texas, for the Northwest corner of this tract; THENCE East, along the South line of said Lot 82, Drury Park, a distance of 150.00 feet to a ½" iron rod found at the Southeast corner of said Lot 82, Drury Park; THENCE South a distance of 1.12 feet to a point for an interior corner of this tract; THENCE East a distance of 465.00 feet to a point in the East line of that tract of land described in Volume 6018, Page 316, Real Property Records of Lubbock County, Texas, for the Northeast corner of this tract; THENCE South, along the East line of said described tract, a distance of 10.00 feet for the Southeast corner of this tract; THENCE West a distance of 615.00 feet to a point in the East right-of-way line of Quaker A venue for the Southwest corner of this tract; THENCE North, along the East right-of-way line of Quaker A venue, a distance of 11.12 feet to the Point of Beginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. ., • VOL 7 4 73 PAG£206 SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
