ORDINANCE NO. 4352
AN ORDINANCE TO SET THE WATER RATES FOR WATER TO BE
FURNISHED TO TEXAS TECHNOLOGICAL COLLEGE THROUGH AUGUST 31.
1967; TO PROVIDE FOR ACCUMULATIVE BILLING FOR ALL WATER USED BY
THE COLLEGE; TO PROVIDE FOR NOTICE IN ADVANCE TO THE COLLEGE
IN THE EVENT THAT WATER RATES SHALL BE INCREASED AFTER AUGUST
31, 1967; AND TO DECLARE AN EMERGENCY AND EFFECTIVE DATE OF TH
ORDINANCE; TO PROVIDE FOR PUBLICATION OF TIDS~CONTRACT ORDINAN
AND ITS ACCEPTANCE BY TEXAS TECHNOLOGICAL COLLEGE.
WHEREAS, the City Council finds it to be in the public interest that a
water re.te be established for Texas Teclmological College, and that an agreemen
or contract should be made by and between the City of Lubbock and Texas Tech-
nological College; and,
WHEREAS, the water rate for Texas Technological College has been
established by Ordinance No. 4229; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1., THAT the City of Lubbock shall supply water to Texas Tech
nological College at the rates set out by Ordinance No. 4229; said rates to apply
for the first one million {1, 000, 000) gallons per month, and after such first mil-
lion gallons per month, the rate shall be thirty cents {. 30~) per one thousand
(1, 000) gallons.
SECTION 2. THAT all meters used for measuring water consumed on
the Texas Technological College Campus, as contemplated by this Ordinance and
the contract hereby established by and between the City of Lubbock and Texas
Technological College, shall be totaled and the College billed as if all water con-
sumed passed through one meter.
SECTION 3. Texas 1I'echnological College shall, within fifteen {15) days
from the date of the passage of this Ordinance by the City Council of the City of
Lubbock, file with the City Secretary of the City of Lubbock,. a written statement,
signed for and on behalf of Texas Technological College by a duly authorized
official of Texas Technological College, in the following form:
"To the Honorable Mayor and City Council of the City of Lubbock.
Texas Technological College hereby accepts the attached Ordinance
passed by the City Council of Lubbock the day of _____ _
1964, and agrees to be bound by all of its terms and conditions.

SECTION 4. In the event that the water rates described herein shall be
increased for the College after August 31~ 1967, the City shall provide notice of
such rate increase by July, 196'6; provided, however, that1his advance notice
shall in no way be considered as a condition precedent to an increase in such
water rates for the College.
SECTION 5. The rule requiring an Ordinance to be read on two readings
before final passage is hereby suspended, and this Ordinance is declared to be an
emergency measure for the reasons set forth in the preamble hereef and by
reason that the rates set out herein are presently in effect. and this Ordinance
shall take effect immediately upon passage.
