HomeMy WebLinkAboutOrdinance - 2001-O0081 - Amending Zoning Ordinance 7084 Zone Case 1193-B Change R-1 To IHC, IHI - 09/27/2001First Reading September 27, 2001 Item No. 39 Second Reading October 11, 2001 Item No. 15 ORDINANCE NO. 2001-000&1 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1193-B; A ZONING CHANGE FROM R-1 TO IHC SPECIFIC USE AND IHI SPECIFIC USE ZONING FOR MANUFACTURED HOME SALES, STORAGE AND REMANUFACTURING ON BLOCK 5, EDSALL ACRES ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code 3211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen ( 15) days prior to the date of the public hearing before the City Council on the proposed amendment, and the public hearing according to said notice, was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was determined by the City Council that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1193-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-24( c )(24) of the Code of Ordinances of the City of Lubbock from R-1 to IHC Specific Use and IHI Specific Use for manufactured home sales, storage, and remanufacturing on Block 5, Edsall Acres Addition, City of Lubbock, Lubbock County, Texas, located at 4002 N. IH 27 and subject to the following conditions: a. The west 350 feet shall be zoned IHC Specific Use. b. The east 675.48 feet shall be zoned IHI Specific Use. c. The land, while used in conjunction with manufactured home sales and service, shall be controlled with the following conditions: • The 400 foot refurbishment area shall be fully screened on the south and west and east sides, except for entry gates on the east and west (the east fence shall not be required if the storage area noted below provides an east fence). If the south lot is used, the same screening shall be provided. This screening shall not include "as the use of the area expands", but the entire 400 feet from the outset. Display units may be used for screening on the west line, otherwise picket fencing shall be used. The fencing shall be installed by February 1, 2002. • Refurbishment shall not include rebuilding/reconstruction. Typical paint up, fix up of experienced units shall be the limit of refurbishment. • If the east 275.48-foot area is used for storage (see next bullet), a screening fence shall be installed on the entire east (Elm) side and the south side of the north parcel, and relocated to the new south line if the business is expanded to the south parcel. A gate may be installed in the fence along Elm, but shall be closed at all times unless a unit is being moved. After the move, the gate shall remain closed. • Units damaged beyond minor repair and/or refurbishment shall not be allowed in the storage area. All existing wrecked and heavily damaged units shall be removed by January 1, 2002. • The display, refurbishment and storage areas may use crushed material versus asphalt. • The display area adjacent to I-27 shall-maintain a minimum twenty-five (25) foot setback for display units and the office. • The 25-foot area adjacent to I-27, less any drives, shall be landscaped with turf and shrubs, with trees optional. • Platting of the property shall be completed by December 1, 2001. d. If any of the dates (January 1st for removal of damaged units; December 1st for platting; and everything else including fencing by February 1st) are not met, the zoning shall revert to single family on February 2, 2002, and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
