HomeMy WebLinkAboutOrdinance - 2001-O0080 - Amending Ch 8 Code Of Ordinances Section 8-4 Voting Districts - 09/27/2001First Reading September 27, 2001 Item No. 15 Secaxf JeadirYJ October 11, 2001 Item No. 79 ORDINANCE NO. 2001-00080 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF SECTION 8-4 WITH REGARD TO ESTABLISHMENT OF VOTING DISTRICTS FOR CITY COUNCIL MEMBERS BASED UPON THE 2000 FEDERAL CENSUS; AMENDING VOTING PRECINCT BOUNDARIES, VOTING PLACES, AND VOTING DISTRICTS AS REQUIRED BYLAW; PROVIDING A MAP OF THE VOTING PRECINCTS AND DISTRICTS OF THE CITY OF LUBBOCK; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE AND IMPLEMENTATION. WHEREAS, the City Council of the City of Lubbock has received the results of the 2000 federal census and has studied such results itself and by means of a Redistricting Advisory Committee, whose final report is attached hereto as Exhibit A, and made a part hereof for all purposes; and WHEREAS, two public hearings were conducted on various plans for redistricting submitted by the City staff, consultants and various committee members on August 23, 2001; and WHEREAS, the City Council after due consideration of the recommendation of the Redistricting Advisory Committee and other information provided by the staff, consultants and the public has determined that it would be in the best interest of the citizens of the City of Lubbock to require that the following changes be made to the Voting Precincts and City Council Districts in keeping with the requirements ofthe Voting Rights Act of 1965, as amended, and the judgment in Jones v. City of Lubbock, No. 79-2744, Northern District of Texas; and WHEREAS, Section 276.006 of the Election Code states that any change to election district boundaries from which an officer is elected shall not be effective until three (3) months from the date of final approval of the change; and WHEREAS, the this ordinance shall not be implemented until such time as final approval is obtained from the U.S. Department of Justice as required by federal law; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Subsection 8-4(a) ofthe Code of Ordinances ofthe City ofLubbock, Texas, is hereby amended to delete therefrom Voting Precinct No. 71. SECTION 2. THAT Subsection 8-4(a) ofthe Code of Ordinances ofthe City ofLubbock, Texas, is hereby amended to read as follows with regard to the following named voting precincts: Voting Precinct No. 113. Beginning at the intersection ofNorth Quaker Avenue and Ursuline Street; thence south along North Quaker Avenue to its intersection with Marshall Street; thence west along Marshall Street to its intersection with North Utica A venue; thence south along North Utica A venue to its intersection with Erskine Street; thence west along Erskine Street to its intersection with North Frankford Avenue; thence north along North Frankford A venue to its intersection with Ursuline Street; thence east along Ursuline Street to the point of beginning. The voting place shall be Broadview Baptist Church. Voting Precinct No. 114. Beginning at the intersection of North Quaker Avenue and Marshall Street; thence south along North Quaker Avenue to its intersection with Erskine Street; thence west along Erskine Street to its intersection with North Utica A venue; thence north along North Utica A venue to its intersection with Marshall Street; thence east along Marshall Street to the point ofbeginning. The voting place shall be as designated by election order. SECTION 3. THAT subsection 8-4(b) ofthe Code of Ordinances ofthe City ofLubbock, Texas, is hereby amended to read as follows with regard to the following named City Council voting districts: Council District No.1: Precinct Nos. 1, 2, 3, 4, 5, 8, 10, 17, 18, 79, 80, 86, 87, 88, 89, 90, 95, 97, 98, and 114. Council District No.5: Precinct Nos. 7, 27, 55, 57, 62, 66, 73, 78, 96, 104, 110, 111, and 112. Council District No.6. Precinct Nos. 9, 13, 47, 50, 53, 58, 59, 63, 72, 76, 92, 93, and 113. SECTION 4. THAT subsection 8-4(c) ofthe Code of ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (c) The voting districts, voting precincts and voting places set out in this section are hereby delineated on the map denominated "City of Lubbock Voting Precincts/Districts/ Adopted October 11, 200 1/0fficial Map." A copy of said map is attached and made a part of this section as if fully copied herein in detail. A copy ofthe original of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 5. THAT all portions of Chapter 8 of the Code of Ordinances not amended by this Ordinance shall remain the same. 2 SECTION 6. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety in both English and Spanish languages following final passage by the City Council. SECTION 8. THAT this Ordinance shall effective upon final passage but shall not be implemented for any election conducted by the City of Lubbock for three (3) months following final passage by the City Council upon second reading in accordance with Section 276.006 ofthe Election Code and until such time as approval to implement said changes in voting practices and procedures is obtained from the U.S. Department of Justice.
