D. 57). 02-2.'7 -!~Col+ ORDINANCE NO. 4320 'Y AN ORDINA!llCE AUTHORIZDJG THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT ·FROM ,o MILES PER HOUR TO 40 MTI.ES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLlOWS: L/3;20 On both sides of Indiana beginning at the south side of 50th Street and extending south to 5$th Street. AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROIIIDING FOR PUBLICATION; AND D:Em.ARIN'G AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDDTANCE. WHERFAS9 the governing body ll as authorized by Article 827a, Seco S, Vernon's A~~otated Penal Code~ finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth, which creates an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF '!'HE CITY OF LUB'10CK: S~TION 1. The prima. facie speed limit established by Article 827a, Sec. 8, Subsection 1 (b), Vernones Annotated Penal Code is altered and changed for all vehicles to 40 miles per hour on the following designated highways or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: Onlboth sides of Indiana beginning at the south side of 50th Street and extending south to 5$th Street. SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinancea SECTION J.. Any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLlARS ($200 .. 00) and for subsequent viola- tions within one year thereafter shall be prosecuted as prescribed for such violations by Se~o 15 of Article 827a, Vernon~s Annotated Penal Code. SECTION 4o The City Secretary is authorized and directed to cause the publication of the descriptive caption of this 0:::-dir-.ance together with the penalty provision as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and convenience requires that this Ordinar.ce be passed as an emergency measure for reasons set forth in t he preamble hereof, the r-ule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is de- clared to be an emergency measure to take effect for and after its passage ..
