A.N ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE
SPEED LIMIT FROM 30 MILES PER HOUR TO 35 Mll.PS PER HOUR ON THAT PORTION'
OF THE STREETS DESCRIBED AS FOLLOWS:
On both sides of Indiana Avenue beginning at the south side of
34th Street and extending south to 50th Street.
AUTHORIZING THE PLACING OF ~PEED LIMIT SIGNS~ PRESCRmiNG A PENAL'rY; PROVIDING
FOR PUBLICATION~ AND DECLARING AN »mRGENCY; AND PROVIDING FOR THE EFFF..CTIVE
DATE OF THIS ORDINANCE.
'WHEREAS:> the governing body11 as authorized by Article 827a, Sec. 8,
Vernon's Annotated Penal Code~ finds that certain prima facie speed limits on
certain highways are different from what is reasonable or safe and should be
altered and the immediate preservation of public health and safety requires
immediate alteration of said prima facie speed limits as hereafter set forth,
which creates an emergency; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CI'l'Y CF LUB9CCK:
SJ'hTION 1. T'ne prima facie speed limit established by Article 827a,
Sec. 8, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed
for all vehicles to 3 5 miles per hour on the following designated highways
or street in the corporate limits of the City of Lubbock, Lubbock County,
Texas, to-wit:
On both sides of Indiana Avenue beginning at the south side of
34th Street and extending south to 50th Street.
SECTION 2. The City Manager is authorized and directed to cause the
placing of signs so as to clearly define the limits of the prima facie areas
set out in this Ordinance.
SECTION 3. Any person~ firm or corporation violating the prima facie
speed limit established by this Ordinqnce shall upon conviction be fined in
any sum not to exceed TWO HUNDRED DOLlARS ($200.00) and for subsequent viola-
tions within one year thereafter shall be prosecuted as prescribed for such
violations by Seeo 15 of Article 827a, Vernon~s Annotated Penal Code.
SECTION 4. The City Secretar.y is authorized and directed to cause
the publication of the descriptive caption of this Ordina-nce together with

the penalty provision as an alternative method of publication as provided by law.
SECTION 5. The fact that public necessity and convenience requires
that this Ordinance be passed as an emergency measure for reasons set forth in
the preamble hereof, the rule requiring that no Ordinance shall be finally
passed on the day of its introduction be suspended, and this Ordinance is de-
clared to be an emergency measure to take effect for and after its passage.
AND IT IS SO ORDERED.
