HomeMy WebLinkAboutOrdinance - 4317-A-1964 - Amending Ordinance No. 3213, Zone Case No. 850. - 02/13/1964DR:ks 91-3-64 02-1!3--....... -r 03-I ;L-~U,Lf ORDINANCE NO. -~;!_17 !_ __ AN ORDINANCE AMENDING ORDINANCE NO. 3213, ZONE CASE NO. 85 BY DELETING THE ©NDITIONS THEREIN SET OUT SO THAT SECTION 1-1 S L HEREAFTER READ AS FOLLOWS: SUBJECT TO THE FOLLOWING CONDITION 1. THAT A MINIMUM 6' SOLID PERMANENT TYPE SCREENING FENCE SHAL BE CONSTRUCTED AND PERMANENTLY MAINTAINED ALONG THE WEST PROPERTY LINE OF THE PROPERTY. SAID FENCE TO COMPLY WITH SECT 15. 1-2-2 OF THE ZONING ORDINANCE. WHEREAS, in Ordinance No. 3213, certain conditions were set out in the changes of Lots 1 and 2, Block 13, O'Neill Terrace Addition, City of Lubbock, Lubbock County, Texas, from an "R-211 to a uC-311 zoning district, to-wit: 1. Building shall be for office use only. 2. Building shall be a maximum of two stories in height. 3. Total floor space of building shall not exceed approximately 9000 square feet. 4. The building set-back shall be 25 feet from the 27th Street property line and 43 feet from the Avenue Q property line. 5. A minimum of 25 off-street parking spaces shall be provided. 6. A minimum 6 foot screening fence shall be constructed and maintained alond the West side of the property extending to no further North than the building setback line provided for in condition 4 above for 27th Street. 7. In the event the property is used by its owner and/ or occupant for uses other than herein permitted and/or is used or occupied in violation of this Ordinance, such property shall ipso facto revert back to the 11R-211 zoning district. WHEREAS. the City Council of the City of Lubbock finds that such conditi s are not practical and it would be in the public interest to change the conditions as set out in the body of this Ordinance, NOW .. THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT Sections 1-1 through 7, Ordinance No. 3213 and the same is hereb deleted entirely and substituting therefore: 111. That a minimum 6 1 solid per- manent type screening fence shall be constructed and permanently maintained along the West property line of the property. Said fence to comply with Section 15. 1-2-2 of the Zoning Ordinance. AND IT IS SO ORDERED. Passed by the Council on first reading this 13th day of February , 1964.
