ORDINANCE NO. 4316
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW-
ING CHANGE: ZONE CASE NO. 1207: CHANGE LOTS 1, 2, and 3, BLOCK 6,
McLARTY CIRCLE VIEW ADDITION, CITY OF LUBBOCK LUBBOCK COUNTY
TEXAS .. FROM AN "R-111 TO AN "R-311 ZONING DISTRICT: SUBJECT TO CON
DITIONS.
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Council and after due consideration,
the City Council finds that making the proposed change as hereinafter set out
will be in the public interest; and,
WHEREAS,. all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695 as well
as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amend
ed in 1953, and notice was duly published in the Lubbock Morning Avalanche
Journal more than fifteen {15) days prior to the date of the public hearing befor
the City Council on such proposed amendment, and the public hearing accordin
to said notice was duly held in the City Council Room on the second floor of the
City Hall, Lubbock, Texas, at which time persons appeared in support of the
proposal; and, after said hearing, it was by the City Council determined that it
would be in the public interest, due to changed conditions, that the Zoning Ordi
nance and the Zoning Map be amended in the manner hereinafter set forth in
the body of this Ordinance and this Ordinance having been introduced in final
written form prior to first reading hereof; NOW,. THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Qrdinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows, to-wit:
ZONE CASE NO. 12 07
Change Lots 1, 2, and 3, Block 6, McLarty Circle View Addition,
City of Lubbock, Lubbock County, Texas, from an 11R-111 to an
nR-311 Zoning District;
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the use of said property be restricted only to development for
apartment dwellings and/or subject to Specific Use Permit for pro-
fessional type offices as provided in Section 14-A. 1 of the Compre-
hensive Zoning Ordinance of the City of Lubbock and the further con-
dition that 1, 500 square feet of lot area shall be provided for each
apartment unit if the said property is developed for and used for
apartments.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots. tracts and parcels of land described in Section 1 hereof sh 11
be changed.:to the zoning district indicated and the Official Map is amended in
accordance herewith.
AND IT IS SO ORDERED.
