HomeMy WebLinkAboutOrdinance - 2001-O0063 - Amending Chapter 16 Code Of Ordinances Reguard To Speed Limit In Work Zones - 09/30/2001First Reading August 30, 2001 Item No. 20 ORDINANCE NO. 2001-00063 Second Reading September 13, 2001 Item No. 21 AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO SPEED LIMITS IN WORK ZONE AREAS; PROVIDING AN EFFECTIVE DATE; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council is authorized by Section 542.202 and 545.356 of the Transportation Code to make changes to prima facie speed limits based upon engineering and traffic investigations; and WHEREAS, the City Council finds that in areas of work zones on streets, roads, and highways, the danger to motorists is greatly increased and reduction of the prima facie speed limits in work zone areas is important to the public health, safety and welfare; and WHEREAS, the city traffic engineer has found, based upon engineering and traffic investigations, that the most effective method of controlling speed limits in work zone areas is to base the prima facie speed limit in said areas in accordance with the Work Zone Speed Limit Worksheet as prepared by the Texas Department of Transportation; and WHEREAS, the Citizens Traffic Commission has recommended that the City Council approve the lowering of the prima facie speed limits in work zones in accordance with the above-referenced Work Zone Worksheet; and WHEREAS, the City Council desires to lower the prima facie speed limit in work zone areas in accordance with the above-referenced Work Zone Speed Limit Worksheet; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 16-178 of the Code of Ordinances, City of Lubbock, Texas, is hereby added to read as follows: Sec. 16-178. Speed Limits in Work Zone Areas. (a) The Work Zone Speed Limit Worksheet, prepared by the Texas Department of Transportation and recommended to the City Council by the city traffic engineer and the Citizens Traffic Commission on the 18th day of July, 2001, are hereby approved and incorporated into this chapter by reference and the prima facie speed limits in work zone areas shall be governed by said worksheet. A copy of such worksheet shall be placed on file with Ordinance No. ___ by the city secretary and a copy shall be maintained by the city streets and drainage engineering department, which copies shall be made available for public inspection during the normal business hours of the offices in which they are maintained. (b) The city manager or his designee, except as otherwise directed from time to time by the City Council by resolution, shall have the power and is hereby authorized to lower the prima facie speed limit that is posted in accordance with Section 16-175.1 and/or Section 16-175.2 of this chapter on those portions of vehicle ways that are within work zone areas. The prima facie speed limit within such work zone areas shall be set in accordance with the Work Zone Speed Limit Worksheet. Said lowering of the prima facie speed limit shall only be in effect on those portions of the vehicle ways that are within a work zone area. The prima facie speed limit on the remainder of the vehicle ways that are not included within the work zone area shall remain the posted prima facie speed limit as listed in Section 16-175.1 and/or Section 16-175.2 of this chapter. After completion of the work in the work zone area, the prima facie speed limit shall automatically revert to the prima facie speed limit as listed for that vehicle way in Section 16-175.1 and/or Section 16-175.2 of this chapter. ( c) For purposes of this section, the term "work zone area" shall mean an area of a highway, street, road, or other vehicle ways and portions thereof with construction, maintenance, or utility work activities. A work zone is typically marked by signs, channelizing devices, barriers, pavement markings, and/or work vehicles. It extends from the first warning sign or rotating/strobe lights on a vehicle to the END ROAD WORK sign or the last temporary traffic control device. SECTION 3. THAT in accordance with paragraph (c) of Section 545.356 of the Transportation Code, such new speed limits as may be enacted shall become effective when signs are erected giving notice of the new speed limit, but not earlier than ten (10) days after final publication of this Ordinance by the City Secretary. SECTION 4. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars ($200.00) as provided by Section 1-4 of the City Code of Ordinances. SECTION 5. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
