ORDINANCE NO. 4309
AN ORDINANCE ESTABLISHING A SCHOOL ZONE ON CHICAGO A VENUE;
ESTABLISHING PRIMA FACIE SPEED LIMIT AT 20 MILES PER HOUR DURING
SCHOOL HOURS IN SAID SCHOOL ZONE: DEFINING "SCHOOL HOURS11: MAKING
IT UNLAWFUL TO PASS WITHIN SAID SCHOOL ZONE: PRESCRIBING A PENALT
FOR VI9LATIONS: PROVIDING FOR PUBLICATION AND DECLARING AN EMER-
GENCY.
WHEREAS, the governing body of the City of Lubbock. upon the basis of an
engineering and traffic investigation finds it necessary to alter prima facie speed
limit established by Article 6701d,. Section 166 (a) 1, Vernonts Texas Civil
Statutes as amended Acts 1963, 58th Legislature, page 455, Chapter 161,. within
the area and at the location named and designated in the body of this Ordinance,.
within the corporate limits of the City of Lubbock and in the immediate vicinity of a
school area during a period of time when the school is in session and school childr
are going to or from the school and playground; and
WHEREAS, the governing body finds it necessary to make provision for the
regulation of moving vehicular traffic within such area regarding passing and stopp
ing forth~ protection and safety of pedestrians crossing the streets within such
area; and
WHEREAS,. it is necessary to the immediate preservation of the public
health and safety to provide for the immediate enactment of such measures con-
stituting an emergency,. NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the following designated location and area is declared t
be school zones and the prima facie speed limit of thirty (30) miles per hour as
established by .Article 670ld~ Section 166 {a) 1. Vernon~s Texas Civil Statutes, is
hereby altered and changed to twenty { 20) miles per hour for all vehicles., during
school hours as herein defined on the following described street, to-wit:
1. On Chicago Avenue beginning 186 feet South of 30th Street
and extending North for 730 feet.
SECTION 2. THAT the Traffic Engineer is hereby authorized and directed
to cause the placement of traffic control signals and/ or signs at the approach to th
schoo.l zone herein designated. The signs shall be placed at the most advantageous
point to be conspicuous to approaching vehicular traffic.
SECTION 3. "School hours" as that term is used herein,. shall be the hour
between 7:30 A.M. and 4:30 P. M. of each Monday through Friday throughout the
calendar year when the school nearest the school zone is in session.
SECTION 4. It shall be unlawful for any person to drive or operate a
vehicle through a school zone as designated and established herein during school
hours in such a !l'lanner as to overtake and pass another vehicle by change of lane.,
being driven in the same direction upon the same street within said school zone by
changing traffic lane.
SECTION 5. It shall be unlawful for any person to drive or operate a vehic e
t h rough the school zones herein designated during school hours at a rate of speed
in excess of the prima facie speed limits herein designated for such school zones.
SECTION 6. Any person violating the prima facie speed limit established
by this Ordinance shall upon conviction be fined as prescribed by the provision of
Article 6701d,. Section 143, Vernon1s Texas Civil Statutes~ and any person violatink
any other Section of this Ordinance shall upon conviction be fined in a sum not
exceeding $200.00.
SECTION 7. If any part or parts of this Ordinance shall be held unconstitu
tional or invalid by any court of competent jurisdiction, such part or parts shall
be deemed a separate~ distinct and independent provision and such holding shall
not affect the remaining portions hereof.
SECTION 8. That all Ordinances or parts of Ordinances conflicting with
any of the provisions hereof are hereby repealed insofar as such conflict exists.
SECTION 9. That the City Secretary is hereby directed to cause publicatio 1 of the descriptive caption of this Ordinance together with the penalty clause as an
alternative method provided by law.
· SECTION 10. That the enactment of this Ordinance being necessary to the
public safety and welfare. of the pedestrian use of the street in the school zone here
in designated and established is hereby declared to be an emergency measure
creating a public necessity that the rule providing that proposed ordinances be pre
sented at two separate meetings be dispensed with and this Ordinance is declared t
be an EMERGENCY MEASURE to take effect from and after the date of its first
publication.
