SPEED LIMIT ON THE NORTH SIDE OF E; 34TH STREET {F.M. 835) BEGINNING 1.095 MILES EAST OF AVENUE A AND EXTENDING SOUTHEAST ON F.M. 835 FORO. 340 MILES; AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREET OR HIGHWAYS NOT SPECIFI ... ALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHE PRIMA FACIE SPEED LilVIIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVIDING A SAVINGS CLAUSE} DECLARING AN ElVIERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS OR DINAN WHEREAS~ the governing body of the City of Lubbock8 as authorized by Article 670ld~ Section 169(b) Vernonts Texas Civil Statutes., finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth., which creates an emergency .. NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 6701d., Section 166{a) 1 ... Vernonts Texas Civil Statutes is altered and changed for all vehicles to 40 miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County., Texas .. to ... wit: On the South Side of E. 34th Street {F. M. 835) beginning at Avenue A and extending East on F. M. 835 for 1.195 miles. SECTION 3. The prima facie speed limit established by Article 6701d, Section 166(a) 1-Vernonrs Texas Civil Statutes is altered and changed for all vehicles to fifty (50) miles per h<;mr on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the South side of E. 34th Street (F. M. 835) beginning 1.195 miles East of Avenue A and extending Southeast of F. M. 835 for o. 434 miles. SECTION 4. The prima facie speed limit established by Article 670ld, Section 166 (a) 1-Vernonts Texas Civil Statutes is altered and changed for all vehicles to forty ( 40) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to ... wit: On the North side of 34th Street beginning at Avenue A and extending East for 1. 095 miles. SECTION 5. The prima facie speed limit established by Article 6701d, Section 166{a) 1-Vernonrs Texas Civil Statutes is altered and changed for all vehicles to fifty (50) miles per hour on the following designated highway or -street in the corporated limits of the City of Lubbock, Lubbock County, Texas, to ... wit: On the North Side of E. 34th Street (F. M. 835) beginning 1. 095 miles east of Avenue A and extending Southeast on F. M. 835 for 0. 340 miles. V SECTION 6. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 7. Any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS and for subsequent violations within one year thereafter shall be prosecuted as prescribed for such violations by Section 15 of Article 827a, Vernonts Annotated Penal Code. SECTION 8. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION 9.. That all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 10. All highways or streets not specifically set forth in the pre- ceding sections hereof shall not be affected by the provisions hereof.,. and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances ex- cept those with which it specifically conflicts. SECTION 11. Should any section .. paragraph, sentence.,. clause .. phrase or word of this Ordinance be declared unconstitutional or invalid for any reasons, the remainder of this Ordinance shall not be affected thereby. v SECTION 12. The fact that public necessity and conveJ:Ence requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof .. the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect from and after its passage.
