AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE
RESULTS OF AN ELECTION HELD IN THE CITY OF LUBBOCK. TEXAS~ ON
JANUARY 7, 1964~ PURSUANT TO ORDINANCE NO. 4247 eALLING FOR A
SPECIAL ELECTION ON CERTAIN PROPOSED AMENDMENTS TO THE CHARTER
OF THE CITY OF LUBBOCK,. TEXAS~ AS SUBMITTED AND VOTED ON BY THE
QUALIFIED ELECTORS OF THE CITY OF LUBBOCK.

mission of the City of Lubbock~ Texas on the 21st day of November .. 1963 propositi s
to amend the Charter of the City of Lubbock were submitted by ballot to the qualifie
voters of the City of Lubbock on January 7, 1964.,. after due notice pursuant to
Section 1, Article 1170, Revised Civil Statutes of Texas, 1925, as amended by the
57th Legislature of the State of Texas, published in accordance with and as directe
therein; and
WHEREAS, said proposed amendments are set out in full in Ordinance No.
4247, pursuant to which ordinance said proposed amendments were submitted for
consideration by the electorate of the City of Lubbock; and.P.
WHEREAS, as directed and in compliance with Chapter 1, Article IX, Sectio
6 of the Charter of the City of Lubbock and the laws of the State of Texas the return
of the Special Charter Amendment Election held January 7, 1964, should be opened
and canvassed and the results thereof declared; and,
WHEREAS, upon consideration of the returns of said election, it appears that
the same was in all respects legally held, after due notice had been given, that
said returns were duly and legally made and properly reflect the results of said
election on all propositions submitted., NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT there .was submitted to the qualified voters of the City
of Lubbock~ Texas, on January 7, 1964, in accordance with the law.t for the
purpose of passing on the question of adopting amendments to the Charter of the
City of Lubbock.., Texas, the questions reading as follows:
Amendment No. 1.
Do you vote to amend the present City Charter of the City of Lubbock, Texas by
repealing Section 2, Article m, Chapter 1 relating to the Mayor or Commissioner
Number One, Commissioner Number Two, Commissioner Number Three or
Commissioner Number Four in the order named acting as Judge or Recorder of the
Corporation Court in case of absence or disqualification of the regular or acting
judge or recorder. ~

Do you vote to amend the prese~t City Charter of the City of Lubbock, Texas by
repealing Section 2 .. Article VII of Chapter 1 which provides that the City shall
have the right to levy and collect an annual poll tax not exceeding $1.00 per year
upon all male inhabitants between the ages of 21 and 60.

Do you vote to amend the present City Charter of the City of Lubbock~ Texas by
amending and changing Section 7, Article VII of Chapter 1 relating to the control
and management of the finances of the City of Lubbock to provide that such control
and management be under the direction of the duly elected governing body.

Do you vote to amend the present City Charter of the City of Lubbock. Texas by
amending Article IX. Chapter 1 by adding a new and additional section which re ...
quires that at every election to fill the elective offices of the City of Lubbock that
the election to each office shall be by a majority of the votes cast for such office
at such election and requiring a run-off in the event no candidate receives a major· ';y
of all the votes cast for such office at such election.

Do you vote to amend the present City Charter of the City of Lubbock, Texas by
amending Section 24, Article IX, Chapter 1 which relates to the issuance of time
warrants issued by the City Commission to provide that the City Commission may
issue time warrants not to exceed the amount now or which may be hereafter allow d
by law.

Amendment No. 6.
Do you vote to amend the prese·nt City Charter of the City of Lubbock, Texas by
amending and changing Sections 1, 2, 3, 4 and 5, Article X, Chapter 1 of the
Charter of the City of Lubbock relating to the appointment of the City Manager,
his compensation and tenure of office~ powers and duties as City Manager by
adding new and additional Sections 1., 2, 3~' 4_, 5~" 6 and 7 to Article X, Chapter 1
to provide that the City Manager be appointed by the governing body of the City
of Lubbock who shall fix his salary and designate his tenure of office and making
the City Manager the chief administrative officer of the City Government, more
specifically defining his responsibilities and duties to the governing body for
proper administration of affairs of the City under his control by terms of the
Charter of the City of Lubbock or by the governing body of the City of Lubbock
requiring that an Acting City Manager be named by him or the governing body in
the event of his absence or temporary disability to serve as City Manager and
enumerating the responsibilities between the City Manager and the governing body
of the City concerning administrative personnel of the City of Lubbock~ and furthe
prohibiting the appointment by the City Manager of persons with certain degrees o
r~lationship.

Do you vote to amend the present City Charter of the City of Lubbock, Texas by
amending such Charter relating to the change of the words "City Commission".
"Commission", uCommissioner"~ "Commissioners"~ to provide that the words
"City Council",. "Council",. "Councilman" and "Councilmen" be substituted and
read in lieu of the words "City Commission"# "Commission", "Commissioners".
"Commissioner", and further providing that the term "Councilmen" and "Council ...
man" shall include females who shall be known as "Councilwomen11 and "Council-
woman".

SECTION 2. THAT the qualified voters voted on said question at the polls
and cast their ballots and answered the foregoing questions as follows:

That there were only 997 votes in all cast at said election and that a
majority thereof was cast in the affirmative in answer to each of amendments 1
through 7.
SECTION 3. THAT the aforesaid election was duly and legally called and
notice thereof given in accordance with the laws of the State of Texas and the
Ordinance calling said election; that said election was held in strict conformity
with the Constitution and laws of the State of Texas, and the returns thereof have
been properly made to the officials of the City entitled to receive same; and furthe
that said election properly represents the desires of those qualified to vote therei
and the City Commission has duly canvassed the election returns and find that a
majority of the qualified voters favor the adoption of Amendment Numbers 1 throu
7 aforesaid and that they have legally carried, been adopted and approved.
SECTION 4.. It is ordered that said proposed amendments 1 through 7 be and
the same are here by approved and adopted and made a part of the Charter of the
City of Lubbock, Texas; and that a copy of said Ordinance ordering the said
election to ""Wit number 424 7 as well as this Ordinance be recorded in full in the
proper records of the City of Lubbock.
SECTION 5. It is further ordered that the Amendments No. 1 through 7 which
are hereby approved and adopted and made a part of the Charter of the City of
Lubbock shall become effective and be in full force and effect from the date of the
final approval and adoption of this Ordinance.
AND IT IS SO ORDERED.
