Amended by Ordinance 4541 L \. x:....,,. . l -,r - • r.J, J Arilended by 614) ORDINANCE NO. 4251 . \\-ZtD-tq(Jl3 ( c AN ORDINANCE REPEALING ORDINANCE NO. 3420~" 3557 AND 3632 OF THE CITY OF LUBBOCK; ESTABLISHING SCHOOL ZONES; ESTABLISHING PRIMA FACIE SPEED LIMITS AT 20 MILES PER HOUR DURING SCHOOL HOURS IN SUCH ZONES; DEFINING "SCHOOL HOURSt'; MAKING IT UNLAWFUL TO PAS WITHIN SCHOOL ZONES; PRESCRIBING PENALTY FOR. VIOLATIONS# PROVIDI FOR PUBLICATION AND DECLARING AN EMERGENCY.· WHEREAS .. the governing body of the City of Lubbock .. upon the basis of an engineering and traffic investigation finds it necessary to alter prima facie speed limits established by Article 670ld, Section 166 (a} 1 .. Vernonts Texas Civil Statutes as amended Acts 1963# 58th Legislature .. page 455 .. Cliapter 161, within the areas and at the locations named and designated in the body of this Ordinance, all within the corporate limits of the City of Lubbock and in the immediate vicinity of school areas during periods of time when schools are in session and school children are going to or from schools and playgrounds; and WHEREASJI the governing body finds it necessary to make provision for the regulation of moving vehicular traffic within such areas regarding passing and stopping for the protection and safety of pedestrians crossing the streets within such areas; and WHEREAS, it is necessary to the immediate preservation of the public health and safety to provide for the immediate enactment of such measures con- stituting an emergency,_ NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance Nos. 3420 .. 3557 and 3632, BE, and the same are here by repealed. SECTION 2. THAT the following designated locations and areas are declared to be school zones and the prima facie speed limit of thirty (30) miles per hour as established by Article 670ld~ Section 166 (a) 1., Vernon's Texas Civil Statutes. is hereby altered and changed to twenty (20) miles per hour for all vehicles .. during school hours as herein defined on the following described streets ~-wli: · 1. On East Broadway beginning at the West side of the intersection of Teak Avenue and extending West for 447 feet. 2. On 34th Street beginning 130 feet West from the West side of the intersection of Avenue X on the South side of 34th Street and extending East for 566 feet. 3. On Avenue Q beginning 230 feet North from the North side of the intersection of 6th Street and extending South for 7 36 feet. •. ( I c I c _. / 4. On Flint Avenue beginning 150 feet North from the North side of the intersection of 26th Street and extending South for 300 feet. 10. On Avenue H beginning 115 feet South of the South side of the intersection of 50th Street and extending South for 655 feet. 11. On 34th Street beginning 224 feet East of the East side of the intersection of Toledo Avenue on the North side of 34th Street and extending West for 424 feet. ' 12. On Avenue H beginning at the South side fof the intersection of 40th Street and extending South for 720 feet. 13. On Parkway Drive beginning on the East side of the inter- section of Cherry Avenue and extendi~ to the West side of the intersection of Guava Avenue. 14. On Idalou Road beginning 50 feet West of the West side of the intersection of Spruce Avenue and extending East for 946 feet. 15. On Avenue P beginning 373 feet North of the North side of Avenue P and extending South for 624 feet;. 16. On North Avenue U beginning on North side of Cornell Avenue and extending North for 350 feet. SECTION 3. The Traffic Engineer is hereby authorized and directed to .. • .... ( c ( ' . cause the placement of traffic control signals and/or signs at each approach to each school zone herein designated. The signs shall be placed at the most advantageous point to be conspicuous to approaching vehicular traffic. SECTION 4. ttschool hours" as that term is used herein~ shall be the hour between 7:30 A.M. and 4;30 P.M. of each Monday through Friday throughout the calendar year when the school nearest the school zone is in session. SECTION 5. It shall be unlawful for any person to drive or operate a vehicle through a school zone as designated and established herein during school hours in such a manner as to overtake and pass another vehicle by change of lane, being driven in the same direction upon the same street within said school zone by changing traffic lane. SECTION 6. It shall be unlawful for any person to drive or operate a vehic 1 through the school zones herein designated during school hours at a rate of speed in excess of the prima facie speed limits herein designated for such school zones. SECTION 7. Any person violating the prima facie speed limit established by this Ordinance shall upon conviction be fined as prescribed by the provision of Article 670ld~ Section 143, Vernonts Texas Civil Statutes, and any person violatin any other Section of this Ordinance shall upon conviction be fined in a sum not exceeding $200.00. SECTION 8. If any part or parts of this Ordinance shall be held unconstitu 11 tiona! or invalid by any court of competent jurisdiction, such part or parts shall ' be deemed a separate., distinct and independent provision and such holding shall not affect the remaining portions hereof. SECTION 9. That all Ordinances or parts of Ordinances conflicting with an · of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 10. That the City Secretary is hereby directed to cause publicaU n of the descriptive caption of this Ordinance together with the penalty clause as an alternative method provided by law. SECTION 11. That the enactment of this Ordinance being necessary to the public safety and welfare of the pedestrian use of the streets in the school zones herein designated and established is hereby declared to be an emergency measure creating a public necessity that the rule providing that proposed ordinances be presented at two separate meetings be dispensed with and this Ordinance is de- clared to be an EMERGENCY MEASURE to take effect from and after the date of it first publication.
