First Reading June 26, 2001 Item No. 21 32956 fi!lil And Return To !d Bucy R-0-W ORDINANCE NO. 2001-00048 Second Reading August 30, 2001 Item No. 18 VOL 7277itlCE267 AN ORDINANCE ABANDONING AND CLOSING A 15 FOOT ALLEY LOCATED IN BLOCK 2 & 3 SUBURBAN HOMES ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SA VIN GS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the alley portion as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same for alley purposes and for public use and it would be in the public interest to close, vacate and abandon the same for alley purposes and public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portion as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for alley purposes and for public use, such alley being more particularly described as follows: Metes and bounds description for the closure an alley located in Block 2 and 3 Suburban Homes Addition to the City of Lubbock, Lubbock County, Texas, according the map, plat and/or dedication deed thereof as recorded in Volume 1820, Page 629, and Volume 940, Page 517 and Volume 1515, Page 115 Deed Records of Lubbock County, Texas and Volume 5695, Page 321, Official Real Property Records of Lubbock County, Texas; Beginning at a found 1/2" iron rod in the North right-of-way line of 50th Street that is the Southeast corner of a 15 foot wide alley, same corner being the Southwest corner of Lot 2, Block 3, Suburban Homes Addition to the City of Lubbock, according to the map, plat and/or dedication deed recorded in Volume 940, Page 517 of the Deed Records of Lubbock County, Texas; THENCE West, along the North right-of-way line of said 50th Street, a distance of 15.00 feet to a point that is in the West line of said alley, same being the Southeast corner of Lot 1, Block 3, of said Suburban Homes Addition according to the map, plat and/or dedication deed recorded in Volume 859, Page 276, Deed Records of Lubbock County, Texas; THENCE North, along the West line of said alley, same being the East lot line of said Lot 1, at 178.3 feet pass the Northeast corner of said Lot 1, continuing for a total distance of 186.00 feet to a point in the North line of said alley, same .- being in the South lot line of Lot 4, Rowan Subdivision to the City of Lubbock according to the map, plat and/or dedication deed recorded in Volume 1321, Page 549 of the Deed Records of Lubbock County, Texas; THENCE N. 89°54'52" E., along the North line of said alley, same being the South lot line of said Lot 4, Rowan Subdivision, at 88.45 feet pass a found 1/2" iron rod for the Southeast corner of said Lot 4, Rowan Subdivision, same being the Southwest corner of Lot 1-A, Block 2, of said Suburban Homes Addition according to the map, plat and/or dedication deed recorded in Volume 1820, Page 629 of the Deed Records of Lubbock County, Texas, at 292.70 feet pass a found 3/811 iron rod for the Southeast corner of said Lot 1-A, continuing along the North line of said alley for a total distance of 412.78 feet to a point in the West right-of-way line of Avenue "G" according to the deed recorded in volume 448, Page 637 of the Deed Records of Lubbock County, Texas; THENCE S. 03°31 '53" E., along the West right-of-way line of said Avenue "G", a distance of 17.53 feet to a set 1/2" iron rod with cap for the Northeast corner of Lot 4, Suburban Homes Addition according to the map, plat and/or dedication deed recorded in Volume 5695, Page 321 of the Real Property Records of Lubbock County, Texas, same point being in the South line of said alley; THENCE West, along the North lot line of said Lot 4, same being the South line of said alley, a distance of 103 .4 feet to a set 1/2" iron rod for the Northwest corner of said Lot 4, same being in the East lot line of Lot 3-A, Block 3 of said Suburban Homes Addition according to the map, plat and/or dedication deed recorded in Volume 1515, Page 115 of the Deed Records of Lubbock County, Texas; THENCE North, along the East lot line of said Lot 3-A, a distance of 2.5 feet to a found 3/4" iron pipe that is the Northeast corner of said Lot 3-A, same corner being in the South line of said alley; THENCE West, along the North lot line of said 3-A, Block 3, same being the South line of said alley, at 223 .30 feet pass the Northwest corner of said Lot 3- A, same being the Northeast corner of said Lot 2, Block 3, continuing for a total distance of 285.46 feet to a cross found cut in concrete for the most Northerly Northwest corner of said Lot 2; THENCE S. 45°W., along the lot line of said Lot 2, same being the Southeast line of said alley, a distance of 14.14 feet to a found 1/2" iron rod for the most Westerly Northwest corner of said Lot 2 and the East right-of-way line of said alley; VOL 7277 PAG£269 THENCE South, along the West lot line of said Lot 2, same being the East right-of-way line of said alley, a distance of 161.00 feet to the PLACE OF BEGINNING. Also included in this alley closure ordinance is the alley area described in Volume 447, Page 425 and Volume 440, Page 518 of the Deed Records of Lubbock County, Texas. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
