Commission that Zoning Ordinance No. 1695 be amended by changing Section 2.10 in order to enlarge the uses permitted thereunder; and., \)(~ I y \ WHEHEAS, all conditions precedent required by law for a valid amendme k \ to the Zoning Ordinance have been fully complied with, as well as giving notices I ,,] c in compliance with Section 20 of Ordinance No. 1695 as well as notices provided rr·.-< -, • '-"" 1-~ by Article lOllf., Vernonts Annotated Civil Statutes, amended in 1953., and notice / D -17-t 3 was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Commission on sue proposed amendment., and the public hearing according to said notice was duly hel I in the City Commission Room on the second floor of the City Hall., Lubbock, Texas at which time persons appeared in support of the proposal; and .. after said hearing it was by the City Commission determined that it would be in the public interest., due to changed conditions., that the Zoning Ordinance be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; and WHEREAS .. it appears that the subject of this ordinance pertains to the preservation of property and affects the safety and welfare of the citizens of the City of Lubbock thereby creating an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 be and the same is hereby amended by changing Section 2.10, which shall be and will read hereafter as follows: "2.10 Automobile Service Station. A building or place designed for the primary purpose of dispensing gasoline., oil, diesel fu.el., liquified petro-j leum gases., greases, batteries,. tires, and other automobile accessories, at retail direct to the motor vehicle trade; and where other services to motor vehicles can be rendered such as, but not limited to, the following: Sale and servicing of spark plugs and other ignition parts; tire~ repair and servicing, but no recapping; replacement of mufflers and tailpipes, water hose, fan belts, brake fluid, light bulbs., floor mats_. seat covers, wiper blades and arms for windshields, replacement of grease retainers and wheel bearings; radiator cleaning and flushing. but not repairs; washing and polishing; greasing and lubrication; installing and repairing fuel pumps and installing fuel lines, fuel filters, carbureto!!s. and air cleaners; wiring repairs; adjusting brakes, installing exchanged brake shoes, installing wheel and master cylinder kits; tuning engines; air conditioner repair and service; wheel balancing and alignment. Pro- vided_. however. that the above automotive services shall never be construed to include any major overhaul; the removal and/or rebul.ding of an engine, cylinder head, oil pan, transmission, differential, radiator, springs, or axles; steam cleaning; body or frame work; painting; up- holstering; and replacement of glass. tr SECTION 2. City Secretary shall cause the publication of this ordinance once a week for two consecutive weeks in a newspaper regularly published in the City of Lubbock. AND IT IS SO ORDERED.
