ORDINANCE NO. 2001-00029
AN ORDINANCE REPEALING SECTIONS 9-19 AND 9-20 OF
CHAPTER 9 OF THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK, TEXAS AND RESERVING SECTIONS 9-19 AND 9-20 FOR
FUTURE EXP ANSI ON.
WHEREAS, pursuant to Section 9-19 of the Lubbock Code of Ordinances
it has heretofore been provided that the bill for the rates and charges for electric
service provided by the City of Lubbock's municipally owned electric utility,
Lubbock Power & Light, shall be due and payable fifteen (15) days after issuance;
WHEREAS, pursuant to Section 9-20 of the Lubbock Code of Ordinances
it has heretofore been provided that any customer of Lubbock Power & Light that
has had their electric service disconnected for failure to pay for electric service
within the fifteen (15) days proscribed in Section 9-19 and after affording
themselves of all process due as proscribed in Section 9-20 and who has
subsequently paid all past due and delinquent charges for electric service to
Lubbock Power & Light and who desires to reconnect their electric service has
been required to pay a reconnection charge of six dollars ($6.00) during normal
working hours and fifteen dollars ($15.00) outside of normal working hours;
WHEREAS, the City Council of the City of Lubbock deems it to be in the
best interest of the citizens of the City of Lubbock to improve the efficiency and
competitiveness of the municipally owned electric utility, Lubbock Power &
Light; and
WHEREAS, the City Council of the City of Lubbock deems that it is in
the best interest of the citizens of the City of Lubbock to repeal Section 9-19 and
9-20 of the Code of Ordinances of the City of Lubbock to improve the efficiency
and competitiveness of it's municipally owned electric utility, Lubbock Power &
Light; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK, TEXAS:
SECTION 1: THAT section 9-19 of the Code of Ordinances, City of
Lubbock, Texas, is hereby repealed in it's entirety. Section 9-19 is reserved for
future expansion.
SECTION 2: THAT section 9-20 of the Code of Ordinances, City of
Lubbock, Texas, is hereby repealed in it's entirety. Section 9-20 is reserved for
future expansion.
SECTION 3: THAT the City Council finds and declares that sufficient
written notice of the date, hour, place and subject of this meeting of the Council
was posted at a designated place convenient to the public at the City Hall for the
time required by law preceding this meeting, that such place of posting was
readily accessible at all times to the general public, and that all of the foregoing
was done as required by law at all times during which this Ordinance and the
subject matter thereof has been discussed, considered and formally acted upon.
The City Council further ratifies, approves and confirms such written
notice and the contents of posting thereof.
AND IT IS SO ORDERED
