HomeMy WebLinkAboutOrdinance - 4216-1963 - Amending Zoining Ordance No. 1695, Zone Case No. 1154. - 10/10/1963AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI- CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANJ ~ ZONE CASE NO. 1154: CHANGE TWO TRACTS OF LAND OUT OF SECTION 2, BLOCK A, LUBBOCK COUNTY., TEXAS, AS INDICATED~' FROM A "R-111 TO A "C-311 AND A "C ... l" ZONING DISTRICT; SUBJECT TO CONDITION. WHEREAS .. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendatior1 which was received by the City Commission and after due consideration., the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and., WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with~ as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro .. vided by Article lOllf, Vernonts Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15} days prior to the date of the public hearing before the City Commission on such proposed amendment, and the public hearing according to said notice was duly held in the City Commission Room on the second floor of the City Hall, Lubbock, Texas, a:t which time persons appeared in support of the proposal; and, after said hearing, ~twas by the City Commission determined that it would be in the public interest:~~ due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO... 1154 Change two tracts of land out of Section 2, Block A, Lubbock County, Texas, as indicated. Said property is further described by metes and bounds to-wit: TRACT 1 (Change from uR-111 to "C-311) BEGffiNING at a point which is 2642. 92 feet West and 1445 .. 44 feet North of the Southeast corner of Section 2, Block A, Lubbock County, Texas, said point being in the west right-of-way line .ot.Zenith Av.enue; THENCE N. 29° E. along the West right-of-way line of Zenith Avenue a distance of 96. 05 feet to a point of curvature; THENCE around a curve to the left having a radius of 89.89 feet, delta angle of 62° 31 1 48 ", tangent distance of 54. 58 feet, chord distance of 93. 3 feet for a curve distance of 98. 10 feet to a point of compound curvature; THENCE around a curve to the left having a radius of 15 feet, delta angle of 90°., tangent distance of 15 feet for a curve distance of 23. 56 feet to a point of tangency in the Southeast right-of-way line of Parkway Drive; THENCE S. 56° 2sr 1211 W. along the Southeast right-of-way line of Parkway Drive a distance of 150 feet; THENCE South a distance of 100 feet; THENCE N. 89° 13 1 40" E. a distance of 102. 98 feet to the PLACE OF BEGINNING. The above described tract contains O. 476. acres of land more or less. TRACT 2 (CHANGE from "R-1" to "C-11~ BEGINNING at a point which is 2642. 92 feet West and 1445. 44 feet North of the Southeast corner of Section 2, Block A. Lubbock County, Texas, said pant being in the West right-of-way line of Zenith Avenue; THENCE s. 29° W. along the West right-of ... way line of Zenith Avenue a distance of 19. 26 feet to a point of curvature; THENCE a0ound a curve to the left having a radius of 141. 51 feet, delta angle of 29 , tangent distance of 36. 60 feet, chord distance of 70. 86 feet, for a curve distance of 71. 63 feet to a point of tangency; THENCE South a distance of 72.03 feet; THENCE S. 89° 11 1 4911 W. a distance of 472. 53 feet to a point in the Southeast right-of .. way line of Parkway Drive; THENCE North 56° 28f 12rr E. along the Southeast right ... of-way line of Parkway Drive a distance of 475. 7 feet; THENCE South a distance of 100 feet; THENCE N. 890 13 1 4011 East a distance of 102. 98 feet to the PLACE OF BEGINNING.·~ The above described tract contains 1. 462 acres more or less. SUBJECT TO CONDITION: That a 6 1 solid permanent type !n'eening fence be erected and permanently maintained along the south property line. SECTION 2. THAT from and after passage and effective date of this Ordinanc , said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance here with.
