HomeMy WebLinkAboutOrdinance - 2001-O0024 - Amending Zoning Ordinance 2909 Change R-1 To IHC And A-1 Unplatted 99.5 Acres - 03/22/2001First Reading March 22, 2001 Item No. 41 Second Reading April 12, 2001 Item No. 25 ORDINANCE NO. 2001-00024 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING -:::£,lfe,_ ~ CHANGES: ZONE CASE NO. 2909; A ZONING CHANGE FROM R-1 To@JAND A-1 ZONING ON AN UNPLATTED 99.5 ACRE TRACT OUT OF THE SOUTHWEST CORNER OF SECTION 36, BLOCK AK, AND THE SOUTHEAST CORNER OF SECTION 35, BLOCK AK, LUBBOCK, TEXAS; PROVIDING A PENAL TY; SUBJECT TO CONDITIONS, PROVIDING A SA VIN GS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (yemon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NO\V THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2909 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: ./If!__. f--"o A change of zoning under the provisions of ~ecti4-29 of the Code of Ordinances of the City of Lubbock from R-1 to~d.A-1 zoning district on an unplatted 99.5 acre tract out of the Southwest corner of Section 36, Block AK, and the Southeast corner of Section 35, Block AK, City of Lubbock, Lubbock County, Texas, located North of 66th Street and South of Spur 327 between Justice Avenue and Pontiac Avenue. Subject to the following conditions and being further described as follows: Metes and Bounds Description on a 12.7 acre tract out of Section 36, Block AK, Lubbock County, Texas, further described as follows: Beginning at a point from whence the Southwest corner of Section 36, Block AK bears West 1095 feet; THENCE North, 664.77 feet; THENCE with a curve to the left, through a central angle of 23°46'58", an arc distance of 45.66 feet, on a chord bearing of N 11°53'29" W, a chord distance of 45.33 feet; THENCE N 51°47'01" E, 277.76 feet; THENCE East, 436.11 feet; THENCE South 880.96 in the South line of Section 36; THENCE West, 645.00 feet to the Place of Beginning and containing 12.7 acres including any Right of Way. Metes and Bounds Description on an 86.8 acre tract out of Section 35 and 36, Block AK, Lubbock County, Texas, further described as follows: Beginning at a point from whence the Southwest corner of Section 36, Block AK bears West 1095 feet; THENCE West, at 1095 feet pass the Southwest corner of Section 36, continuing along the South line of Section 35 a total distance of 2203 feet to the Southwest corner of this tract; THENCE North, 1355 feet to a point in the South Right of Way line of Spur 327; THENCE with a curve to the right, through a central angle of 25°52'44", an arc distance of 1133.08 feet, on a chord bearing of N 80°28'53" E, a chord distance of 1123.48 feet; THENCE East, 1740 feet; THENCE South, 660.00 feet; Zone Case No. 2909 page-2 of4 THENCE West, 436.11 feet; THENCE S 51°47'01" W, 277.76; THENCE with a curve to the right, through a central angle of 23°46'58", an arc distance of 45.66 feet, on a chord bearing of S 11 °53'29" E, a chord distance of 45.33 feet; THENCE South, 664.77 feet, to the PLACE OF BEGINNING and containing 86.8 acres including any Right of Way. SUBJECT TO THE FOLLOWING CONDITIONS: 1. A sixty-foot setback for single story and seventy-five feet for two or more stories from 66th Street. 2. For parcels zoned IHC adjacent to the Spur 327 and 66th Street, development shall include ten percent on-site landscaping. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
